Objective
Article 1- The objective of this Communiqué is to define the composition and labelling requirements of the products that are prepared for restricted energy diets for weight reduction in order to ensure production, preparation, processing, preservation, storage, transport and marketing of these products in proper techniques and under hygienic conditions.
Scope
Article 2- This Communiqué covers:
a) the foods that replaces whole of the daily diets
b) the foods that replaces with one or more of daily diets.
Legal basis
Article 3- This Communiqué has been prepared in accordance with the Turkish Food Codex Regulation published in Official Gazette, dated 16/11/1997, No. 23172.
Definition
Article 4- In this Communiqué, the foods, prepared for energy restricted diets for weight reduction purposes, mean the specifically formulated products that replace either completely or partially with the daily diets, when they are consumed based on the instructions of producers.
Product specifications
Article 5- Foods that are included in the scope of this Communiqué should comply with the composition criteria specified in Annex-1.
Additives
Article 6- The additives used in the products that are included in the Scope of this Communiqué should comply with the chapter “Additives” of Turkish Food Codex Regulation.
Flavourings
Article 7- The flavourings used in the products that are included in the scope of this Communiqué should comply with the chapter “ Flavourings” of Turkish Food Codex Regulation.
Contaminants
Article 8- The products that are included in the scope of this Communiqué should comply with the chapter “Contaminants” of Turkish Food Codex Regulation.
Hygiene
Article 9- The products that are included in the scope of this Communiqué should comply with the chapter “Food Hygiene” of Turkish Food Codex Regulation.
Packaging and labelling-marking
Article 10- Packaging, labelling and marking of the products included in the scope of this Communiqué should comply with the following provisions, in addition to the provisions in the relevant chapter of “Packaging and labelling-marking” of Turkish Food Codex Regulation:
a) Whole components composing the foods specified in the paragraph (a) of Article 2 of this Communiqué should be sold in the same package.
b) The foods specified in the paragraph (a) of Article 2 of this Communiqué should be sold under the expression of “this replaces with total daily diets for weight control purposes”.
c) The foods specified in the paragraph (b) of Article 2 of this Communiqué should be sold under the expression of “this replaces with meals for weight control purposes“.
d) Quantities of protein, carbohydrate, fat and energy value as kJ and kcal in the specified quantity of food presented as ready to consume, should be available with numerical forms on the labels.
e) Average quantities of each vitamins and minerals in particular quantity of the product presented as ready to consume, that have to be taken as indicated in Annex-1 should be available in the labels. Besides, what percentages of the vitamin and mineral quantities for the products indicated in the paragraph (b) of Article 2, are met with the quantities given in the chapter “Packaging and Labelling-Marking” of Turkish Food Codex Regulation should be indicated in the labels.
f) Proper preparation rules and expressions indicating the importance of these rules should, wherever required, be available in the labels.
g) A statement implying the possibility of the food`s laxsative effect should be available in the labels, if it provides daily intake of polyols in excess of 20 g per day when used as instructed by the manufacturer.
h) A statement should be present about the importance of sufficient daily fluid intake per day.
i) The following statements:
- that the products provides sufficient quantities of daily essential nutrients,
- that it should not be used longer than three weeks without a medical advice
should be available in the products stated in the paragraph (a) of Article 2 of this Communiqué.
j) A statement should be available on the products indicated in the paragraph (b) of Article 2 of this Communiqué that the products are useful only when they are consumed as a part of energy restricted diets and that other foodstuff is also an necessary part of this diet.
k) Such statement as the amount or rate of weight loss or a reduction in the sense of hunger or increase in sense of satiety upon the end of consuming these products should not be available in the labelling, advertising and supply to the market of the products covered herein.
Transportation and storage
Article 11- Transportation and storage of the products prepared for energy restricted diets for weight reduction purpose should comply with the chapter “Transportation and Storage of Foods” of Turkish Food Codex Regulation.
Sampling and Methods of Analysis
Article 12- The rules in the chapter “Sampling and Analysis Methods “ of the Turkish Food Codex Regulation should be obeyed during sampling from the production line and storage of the products prepared for energy restricted diets for weight reduction purposes.
Registration and Inspection
Article 13- The establishments which manufacture and sell the products prepared for energy restricted diets for weight reduction purposes are obliged to obey the provisions of this Communiqué during registration, permission, importation, control and inspection. The establishments that do not obey these provisions are subject to legal procedure according to the provisions of the Decree Law No: 560, dated 24/06/1995, on the Production, Consumption and Inspection of Foodstuffs.
Inspection
Article 14- The provisions of this Communiqué are inspected by the Ministry of Health, and Ministries of Agriculture and Rural Affairs, according to the provisions of the Decree Law No: 560, dated 24/06/1995, on the Production, Consumption and Inspection of Foodstuffs.
Compliance with European Union
Article 15- This Communiqué has been prepared within the framework of compliance with European Union having regard to the Commission Directive 96/8/EC on “foods intended for use in energy-restricted diets for weight reduction”.
Provisional Article-1 Presently active establishments manufacturing and selling the products covered in this Communiqué are obliged to obey the provisions of this Communiqué within 1 year following the publication thereof.
Enforcement
Article 16- This Communiqué enters into force on the date of publication.
Execution
Article 17- The provisions of this Communiqué are executed by the Minister of Health and the Minister of Agriculture and Rural Affairs.
ANNEX-1
Basic Composition of the Foods Prepared For Energy Restricted Diets
The specifications of the products prepared according to the instructions of the manufacturer or presented in to the market as ready to consume are as follows:
1. Energy
1.1. The total energy provided by a product that was indicated in the paragraph (a) of Article 2 of this Communiqué, should neither be less than 3360 kJ (800 kcal) nor be more than 5040 kJ (1200 kcal) for the total daily amount.
1.2. The energy provided by a product that was indicated in point (b) of Article 2 of this Communiqué, should neither be less than 840 kJ (200 kcal) nor be more than 1680 kJ (400 kcal) for each meal.
2. Protein
2.1. The energy obtained from the proteins of products that were indicated in point (a) and (b) of Article 2 of this Communiqué, should neither be less than 25% nor be 50% of total daily energy value of the products. The amount of protein in the products indicated in the paragraph (a) of Article2 should not exceed 125 g.
2.2. The provisions indicated here above on proteins are valid for the ones whose chemical indexes are the same as reference proteins given in Annex-2. If chemical index is less than 100% of reference protein, then minimum protein levels should be raised to the same percentage. Chemical index of the protein should not be less than 80% of the reference protein.
2.3. “Chemical index”, is the lowest value of the ratios between the amount of each essential amino acid in tested protein and the amount of each essential amino acid in the reference protein.
2.4. It is permitted to add amino acid only in order to raise food values of proteins and in the ratios required for this purpose.
3. Fat
3.1. Energy provided from fat should not exceed 30% of the total energy value of the product.
3.2. The amount of linoleic acid in the form of glyceride should not be less than 4.5 g in the products indicated in the paragraph (a) of Article 2 of this Communiqué.
3.3. The amount of linoleic acid in the form of glyceride should not be less than 1g in the products indicated in the paragraph (b) of Article 2 of this Communiqué.
4. Dietary Fibre
4.1. The daily amount of dietary fibre content in the products indicated at the paragraph (a) of Article 2 of this Communiqué should neither be less than 10 g nor be more than 30 g.
5. Vitamins and Minerals
5.1.The products indicated in the paragraph (a) of Article 2 of this Communiqué as in total daily diet, should provide minimum 100% of vitamin and mineral quantities given in Table 1.
5.2.The products indicated in the paragraph (b) of Article 2 of this Communiqué, in each meal, should provide minimum 30% of vitamin and mineral quantities given in Table 1. The amount of potassium provided from these products in each meal should, however, be minimum 500 mg.
