Communiqué on the Amendment of the Turkish Food Codex Communiqué on Sweeteners Used in Foodstuffs

Objective
Article 1 – The objective of this Communiqué is to determine the sweeteners used for used for sweetening of foodstuffs and the specifications of table-top sweeteners relating to their use in foodstuffs, packaging and labelling.
Scope
Article 2 – This Communiqué covers sweeteners used in foodstuffs for sweetening of them and used as table-top sweeteners.
Legal Basis
Article 3 – This Communiqué has been prepared in accordance with the on the “Turkish Food Codex Regulation” published in the Official Gazette dated 16/11/1997 and no 23172.
Definitions
Article 4 – In this Communiqué;
With no added sugar: means without any added mono or disaccharides or any other foodstuff used for its sweetening properties.
Energy reduced: means reduction of energy value by at least 30 % compared with the original foodstuff or similar product.
Quantum Satis / QS: means that no maximum level has been determined.
Use of Sweeteners
Article 5 – The provisions relating to use of sweeteners are as follows:
a) Sweeteners are used as sugar substitute in the manufacture of dietary foodstuffs and also used to extend shelf life of product in the manufacture of energy reduced foodstuffs, in foodstuffs that do not cause tooth decaying or in foodstuffs with no added sugar.
b) This Communiqué shall not be applied to foodstuffs that have sweetening properties.
c) This Communiqué shall also be applied to foodstuffs covered by the Turkish Food Codex-Communiqué on Foods For Particular Nutritional Uses.
d) Sweeteners used in the manufacture of foodstuffs or sold directly to consumer shall be only the sweeteners listed in the annexes of this Communiqué.
e) Sweeteners used in the manufacture of foodstuffs may be used only under the conditions specified in the annexes of this Communiqué.
f) Sweetener specified as quantum satis /QS in the annexes of this Communiqué shall be used in accordance with good manufacturing practices - GMP at a dose level not higher than is necessary to achieve the intended purpose and consumer shall not be misled.
g) Unless otherwise laid down in specific provisions, sweeteners shall not be used in foods for infants and young children covered by the Turkish Food Codex - Communiqué on Foods For Particular Nutritional Uses, including foods for infants and young children who are not in good health.
h) The maximum levels determined in the annexes of this Communiqué refer to ready-to eat foodstuffs prepared according to instructions for use.
i) Unless otherwise laid down in provisions of the Turkish Food Codex Regulation, the use of a sweetener is permitted in foodstuffs with no added sugar or energy reduced, in dietary foodstuffs intended for a low calorie diet and in foodstuffs with a long shelf life, other than those specified in the indent (g) of this article and in foodstuffs used in the preparation of a foodstuff in compliance with the provisions of this Communiqué.
j) Sweeteners listed in the annexes of this Communiqué may also be stated in other communiqués of the Turkish Food Codex Regulation relating to additives because of their functions other than sweetening.
Packaging and Labeling – Marking
Article 6 – The following information shall be stated on the packages and/or labels of sweeteners in a legible and indelible way.
The name or the trade name and adddress of the manufacturer or packager or vendor firm,
The name and EC code of sweeteners,
If the substance is as a mixture, the name, EC code and the position in decreasing weight order of each sweetener,
If various substances or food components have been introduced to the sweetener in order to facilitate its dilution, dissolving, standardization, sale or storage, the name, intended use of the introduced substance and the position of each component in decreasing weight order,
The statement “For use in food” or another statement indicating that it will be used in food,
If necessary, special conditions for storage and use,
Instruction for use,
Lot or serial number,
Net weight,
Percentages of components of which the usage in food is restricted,
Date of manufacture,
Expiry date in compliance with the Section on Labeling of the Turkish Food Codex Regulation.
In addition to the items listed above, the following provisions shall also be stated on the labels:
The term, “………-based table-top sweetener” must be stated on the label of the sweeteners and the name/names of the sweetener/sweetener must be written in the blank.
The presence of sweetener must be indicated clearly on the labels of the foodstuffs containing sweetener.
The following warnings must be included on the labels of table-top sweeteners containing polyols and/or aspartame:
- Polyols; excessive consumption may cause laxative effects.
- Aspartame; contains phenylalanine
Methods of Sampling and Analysis
Article 7 – The rules specified in the section of Methods of Sampling and Analysis of the Turkish Food Codex Regulation shall be applied while taking samples from the products covered by this Communiqué. Samples should be analysed according to internationally accepted methods.
Registration and Inspection
Article 8 – The establishments that produce and sell the products covered by this Communiqué shall comply with the provisions of this Communiqué during registration, allowance, importation, control and inspection. The establishments that do not comply with these provisions will be subject to legal proceedings according to the provisions of the Decree Having the Force of Law No.560 on Production, Consumption and Inspection of Foods.
Inspection
Article 9 – The implementation of the provisions of this Communiqué is inspected by the Ministry of Agriculture and Rural Affairs and the Ministry of Health according to the Decree Having the Force of Law No.560.
Compliance with the European Union
Article 10 – This Communiqué has been prepared within the framework of compliance with the European Union, taking into account the Council Directive 94/35/EC on “Sweeteners For Use in Foodstuffs”.
Provisional Article 1 – Presently active establishments which produce and sell the products covered by this Communiqué are obliged to obey the provisions of this Communiqué within one year after the date of its publication.
Enforcement
Article 11 – This Communiqué enters into force on the date of publication.
Execution
Article 12 – The provisions of this Communiqué are executed by the Minister of Agriculture and Rural Affairs and the Minister of Health.

The indicated maximum usable doses refer to ready-to-eat foodstuffs.
* Maximum usable doses for E952 cyclamic acid and its sodium and calcium salts are expressed in free acid.
** Maximum usable doses for E954 saccharin and its sodium, potassium and calcium salts are expessed in free imide.

Communiqué on the Amendment of the Turkish Food Codex Communiqué on Sweeteners Used in Foodstuffs
(Communiqué No: 2002/65)
Article 1 – The definition of “energy reduced” stated in Article 4 of the “Turkish Food Codex - Communiqué on Sweeteners Used in Foodstuffs (Communiqué No: 2002/56) published in the Official Gazette dated 25/8/2002 and no 24857, has been amended as follows:
“Energy reduced: means reduction of energy value by at least 25 % compared with the original foodstuff or similar product.”
Article 2 – This Communiqué enters into force on the date of its publication.
Article 3 – The provisions of this Communiqué are executed by the Minister of Agriculture and Rural Affairs and the Minister of Health.
