Objective
Article 1- The objective of this Communiqué is to determine the specifications of foods for athletes/sportsmen in order to ensure that their production, preparation, processing, storage and marketing is performed in technically appropriate and hygienic ways.
Scope
Article 2 – This Communiqué covers products of high carbohydrate content as described in the Definitions section of this communiqué, beverages for sportsmen and products including proteins and protein components.
Legal Basis
Article 3 - This Communiqué is prepared in accordance with the “Turkish Food Codex Regulation” published in the Official Journal dated 16.11.1997 and with repetitive no. 23172.
Definitions
Article 4 – Within the purpose of this Communiqué:
Foods for sportsmen means the products which are specially formulated and defined below in order to meet the special nutritional requirements of athletes or to assist them in displaying their performances at best level,
- Products of high carbohydrate content; means the products that are formulated in order to increase the reserve of carbohydrates prior to physical activity and accelerating recovery after physical activity,
- Beverages for sportsmen; means the products including carbohydrates and electrolytes which are formulated in order to replace carbohydrates, liquid and electrolytes rapidly,
- Products including proteins and protein components; means the products which are enriched with respect to amino acids, amino acid mixtures, amino acid compounds, protein concentrates and proteins which are formulated to keep the protein balance during periods of intensive physical activity.
Product Specifications
Article 5 – The product specifications of the foods for sportsmen covered in the scope of this Communiqué are given below.
a) The specifications of the products of high carbohydrate content are given below:
i. At least 75 % of the total energy in the products of high of carbohydrate content must be obtained from glucose, sucrose, maltose and glucose polymers.
ii. If the products of high carbohydrate content are in liquid form, then they must include at least 10 % carbohydrate in terms of volume.
b) The product specifications of the beverages for sportsmen are given below:
i. The carbohydrates in the beverages for sportsmen must consist of glucose, sucrose, maltose, fructose and glucose polymers and at least 75 % of total energy must be obtained from these carbohydrates.
ii. The sodium quantity in the beverages for sportsmen must be between 20 mmol/L – 460 mg/L or 50 mmol/L – 1150 mg/L.
iii. The osmolality in the beverages for sportsmen must be 200 – 330 mOsml/kg water. The beverages of osmolality within the range of 270 - 330 mOsml/kg water are named ‘isotonic’.
iv. The quantity of carbohydrates in the beverages for sportsmen must be at least 2 g/100mL and at maximum 10 g/100mL.
c) The specifications of the products that include proteins and protein components are given below:
i) In protein concentrates, the dry matter content of egg, milk, meat or soybean origin proteins must be at least 70 % in dry matter bases.
ii) At least 25 % of the total energy in the products that are enriched with respect to proteins must be obtained from proteins of egg, milk and meat or soybean origin.
iii) Amino acids, mixtures of amino acids and amino acid compounds may be added the protein concentrates and the products that are enriched with respect to proteins.
d) The prohibited products which take place in the “Prohibited Substances List” published by the “ International Olympics Committee – World Agency for Anti-doping” is not covered in the scope of this Communiqué.
Additives
Article 6 – The permissible additives that are used in the products in the scope of this Communiqué must comply with the section on Food Additives of the “Turkish Food Codex Regulation”.
Flavourings
Article 7 – The flavourings in the products in the scope of this Communiqué must be comply with the section on flavourings of the “Turkish Food Codex Regulation”.
Contaminants
Article 8 – The quantities of contaminants in the products in the scope of this Communiqué must comply with the section on contaminants of the “Turkish Food Codex Regulation”.
Pesticide Residues
Article 9 – The quantities of pesticide residues in the products covered by this Communiqué must comply with the section on Pesticide Residues of the “Turkish Food Codex Regulation”.
Residues of Veterinary Drugs
Article 10 – The quantities of residues of veterinary drugs in the products covered by this Communiqué must be comply with the section on Veterinary Drugs of the “Turkish Food Codex Regulation”.
Hygiene
Article 11 – The products covered by this Communiqué must be produced in compliance with the general rules covered in the section on Food Hygiene of the “Turkish Food Codex Regulation”.
Packaging and Labelling – Marking
Article 12 – The packaging of the products covered by this Communiqué must comply with the section on Packaging and Labelling-Marking of the “Turkish Food Codex Regulation”. In addition to the referred section, the following information must also take place on the label.
a) The purpose of use of the product must be indicated.
b) The nutritional reference values given in Annex – 2 of the “Turkish Food Codex – Communiqué on The Rules for General Labelling and Nutritional Labelling” and the nutritional reference values given in Annex of this Communiqué are taken into consideration during nutritional labeling of the product covered by this Communiqué.
c) If vitamin B1 quantity in the products of high carbohydrate content is less than 0,2 mg/100 gram carbohydrate, then a warning statement “it is recommended to be consumed together with vitamin B1” must take place on the label.
d) If vitamin B6 quantity in the products that include proteins and protein components is less than 0,02 mg/100 gram protein, then a warning statement “it is recommended to be used together with vitamin B6” must take place on the label.
e) The osmolality of beverages for sportsmen must be indicated on the label in terms of mOsml / kg water and the electrolyte quantity of these in terms of mg or mmol
f) The warning; “Its consumption must be supported by suitable quantity of water” must take place on the label of the products of high carbohydrate content.
g) One of the following statements: “This food does not meet all the required nutritional elements alone and thus must be consumed together with a sufficient and balanced diet,” and depending on the product specification, “it is food for sportsmen with high carbohydrate content”, “it is food for sportsmen with high protein content”, “it is food for sportsmen with enriched protein” , “it is food for sportsmen which includes amino acid” and “beverage for sportsmen” must take place, as appropriate, on the label of the products of high carbohydrate content and of the products which include proteins and protein components.
h) The phrase “Children under 15 years of age and pregnant women can consume this product only under supervision of a medical doctor or a dietician” must take place under the title of “warning” on the label for all the products covered by this Communiqué except the beverages for sportsmen.
i) In addition, the phrase, “These products must be used according to the suggestions of a medical doctor or a dietician” must take place on the products including proteins and protein components.
j) If a product covered by this Communiqué includes phenilalanin, then the statement “includes phenilalanin” must be written on the label.
Transportation and Storage
Article 13 – The transportation and storage of the products covered by this Communiqué must be in compliance with the section on Transportation and Storage of the “Turkish Food Codex Regulation”.
Sampling and Methods of Analysis
Article 14 – The rules mentioned in the Sampling and Methods of Analysis section of the “Turkish Food Codex Regulation” must be in compliance with in sampling of the products covered by this Communiqué on line of production and in maintenance storehouse. The sample must be analyzed using internationally accepted methods.
Registration and Inspection
Article 15 - The establishments, that produce and sell the products covered by this Communiqué, are obliged to obey the provisions of this Communiqué during registration and permission, importation, control and inspection procedures. The establishments that do not obey these provisions shall be subjected to legal procedures in accordance with the provisions of the ‘Decree Law’ Numbered 560 on the Production, Consumption and Inspection of the Foodstuffs.
Inspection
Article 16 - The implementation of the provisions of this Communiqué shall be inspected by the Ministry of Agriculture and Rural Affairs and the Ministry of Health according to the ‘Decree Law’ No. 560.
Repealed Legislation
Article 17 – The “Turkish Food Codex – Communiqué on Foods fo Sportsmen” published in the Official Gazette dated 09.01.2003 and no. 24988 has been repealed.
Provisional Article 1 - The presently active establishments that produce and sell the products covered by this Communiqué are obligated to obey the provisions of this Communiqué within 6 months from the date of publication.
Enforcement
Article 15 – This Communiqué enters into force on the date of publication.
Execution
Article 16 – This Communiqué is executed by the Minister of Agriculture and Rural Affairs and the Minister of Heath.
