CIRCULAR NO. 37/1 OF 2006-2008 FISHING YEAR REGULATING COMMERCIAL FISHING IN SEAS AND INLAND WATERSYazdır

 

PART 1

Objective and Definitions

Objective

Article-1

(1) The prohibitions, limitations and liabilities below are implemented by the Ministry of Agriculture and Rural Affairs for the 1st September 2006 - 31st August 2008 fishing year pursuant to Fisheries Law dated 22/3/1971 no: 1380 and Fisheries Regulation based upon said Law, to help preserve the quality and the stocks of high sea and inland water fisheries, improve commercial species, and achieve the objectives of the fisheries development plan through economical exploitation of fisheries resources, and increasing the production and fisheries export.

Definitions

Article-2

(1) Definitions of the terms used in this circular hereby are given below:

a) Mesh size: means the distance between the two opposite knots of the tight mesh when the net is wet, irrespective of the thickness of the net string and the knot. It is the mean of measurements in twenty successive meshes with respect to the shooting direction.

b) River: means any running water such as rivers and streams flowing continuously or at times though a specified bed.  

c) Mediterranean Sea: means the water between 29o E (East) longitude and the Syrian border.    (See, Map 1)

ç) Cast Nets: are the kind of surrounding nets which do not close at the bottom (also called circular nets).

d) Ministry: means the Ministry of Agriculture and Rural Affairs.

e) Fish Length (Total Length): means the projected straight distance between the tip of the snout of the fish and the tip of the longer tail fin, with the mouth closed.

Fish length for swordfish is the distance (fork length) between the tip of the lower jaw and the fork of the tail fin.

f) Longline: is the fishing set with more than two fishhooks, with hair and baits or not, each tied up with separate cords.

g) Surrounding Nets: mean the gears which catch the fish by surrounding them and entrapping them within the net.

ğ) Bottom Trawl: means, for fisheries capture, the towed trawl nets reaching the sea ground with doors, and the fishery production performed this way.

h) Aegean Sea: means the water between the mouth of the Meriç River and 29o (East) longitude.

ı) Purse seines: are the nets which can be drawn with a line and closed at the bottom.

i) Provincial Administration: means the Provincial Administration of the Ministry of Agriculture and Rural Affairs.

j) District Administration: means the District Administration of the Ministry of Agriculture and Rural Affairs.

k) Oyster Length: is the diameter longitudinally going down the peak (umbo) at the top of the large shell (on the left).

l) Crayfish, Crawfish and Lobster Length: is the distance from the thorny tip of the snout and the end of the forking tale.

m) Cockle Length: means the diameter longitudinally going down the meeting point of the shells.

n) Blue Crab Length: is the projected straight distance between the tips of the sharp ends at the right and left sides of the shell (carapace).

o) Midwater Trawl: means the trawl nets used in pelagic fishing, which are towed in the midst of the sea water or the surface sea with no contact with the ground, and the fishery production performed this way.

ö) Gillnets or entangling nets are the type of gear which helps catch the fish that are gilled, entangled as they move or enmeshed after hitting the small mesh net to accumulate in the bunt of the large mesh net.

p) Time Prohibition: The months of time prohibition indicated in this circular refer to those in the years when the circular is in force.

Beginning and ending dates of the fishing year indicated in the regulation are also subject to the prohibition.

Marine Prohibitions
SECTION ONE
Trawl Prohibitions

All Sorts of Trawl Prohibitions:

Article-3

(1) All sorts of trawling are prohibited in inland waters, Marmara Sea, the Bosphorus Strait, the south of the line between Kelağra (Galere) Cape and Dalyan (Kilyos) Cape, and in the Dardanelles Strait, as stipulated in the Article 24 of the Fisheries Law no. 1380.

(2) Black Sea

All sorts of trawling are prohibited in;

a) Territorial waters from Ordu Province, Ünye District, Taşkana Cape (41o 08,725’ N-37o 17,531’ E) to Georgian border,

b) Territorial waters from Sinop Province, İnceburun (42o 05,959’ N- 34o 56,695’ E) to Samsun Province, Yakakent District, Çayağzı

Cape (41o 41,040’ N-35o 25,193’ E),

c) Territorial waters between Zonguldak Province, Ereğli Baba Cape (41o 17,342’ N-31o 23,937’ E) and Bartın Province, Amasra District, Tekke Cape (41o 43,694’ N-32o 19,283’ E) (See, Map-2).

(3) Aegean Sea:

All sorts of trawling are prohibited in;

a) In Saros Bay:

1) The area to the east of the line connecting Boztepe Cape in Edirne Province (40º 37,140’ N - 26º 04,403’ E) and Büyük Kemikli Cape in Çanakkale Province (40º 18,979’ N - 26º 12, 905’ E), Gökçeada Aydıncık Cape (40º 09,801’ N - 26º 00,554’ E) and Bozcaada West Cape (39º 50, 259’ N - 25º 57,754’ E).

2) The area to the east of the line connecting Bozcaada Eskifener Cape (39º 47,319’ N - 26º 03,137’ E) and Babakale (39º 28,772’ N - 26º 04,013’ E) (See, Map-3).

b) In Edremit Bay:

The area to the east of the line connecting the mouth of Küçükkuyu Shelter, (39º 32,781’ N-26º 36,421’ E) and Küçük Maden Island (39º 23,135’ N- 26º 34,119’ E), Güneş Island Lighthouse (39º 19,736’ N -26º 32,441’ E), Çıplak Island Yumru Cape (39º 16,722’ N - 26º 34,653’ E) and Eğribucak Cape (39 16,399’ N- 26º 36,589’ E) (See, Map-4).

c)In Dikili Bay:

The area to the east of the line between Madra Stream (39º 09,981’ N - 26º 46,000’ E) and Adatepe (Killik) Cape (39º 02,493’ N - 26º 48,736’ E) (See, Map-5).

ç)In Çandarlı Bay:

The area to the east of the line between Maltepe Cape (38º 57,051’ N - 26º 48,042’ E) and Ilıca Cape (38º 49,397’ N - 26º 53,427’ E) (See, Map-6).

d) In İzmir Bay:

The area to the south-east of the line between Ardıç Cape (38º 31,947’ N - 26º 37,510’ E) and Deveboynu (38º 39,070’ N - 26º 43,509 E) (See, Map-7).

e) In Çeşme Strait:

The area to the east of the line between Çolak Cape (38º 26,716’ N - 26º 23,791’ E), Alev Island Lighthouse (38º 23,303’ N - 26º 16,427’ E), Çeşme Uçburnu (38º 22,593’ N - 26º 17,141’E) (See: Map-8).

f) In Sığacık Bay:

The area to the north of the line between Gök Port (38º 08,445’ N – 26º 37,475’ E) and Kilik Cape (38º 09,829’ N – 26º 46,515’ E) (See: Map-9).

g) In Kuşadası Bay:

The area to the east of the line between Sünger Cape (38º 00,864’ N - 27º 04,540' E) and Yalancı Cape (37º 51,650’ N - 27º 14,399’ E) (See: Map-10).

ğ) In Dilek Strait:

The area to the east of the line between Çatal Cape (37º 38,471’ N - 27º 04,759’ E) and Tekağaç Cape (37º 21,340’ N - 27º 11,634 E) (See: Map-11).

h) In Yeşilova Bay:

The area to the east of the line between Kızılada (36º 39,035’ N - 28º 02,426’ E) and the Karaburun at the opposite (36º 36,558’ N - 28º 03,021’ E) (See: Map-12).

ı) In Hisarönü Bay;

The area to the east of the line between Dil (Lindos) Cape (36º 45,557’ N - 28º 00,727’ E) and the Ağıl Cape at the opposite (36º 41,638’ N- 27º 58,698’ E) (See: Map-13).

i) In Gökova Bay;

1) The area to the east of the line between Ören Cape (37º 01,055’ N- 27º 56,751’ E) and Teke Cape at the opposite (36º 54,410’ N- 28º 00,921’ E)

2) The area to the east of the line connecting Mersincik Cape (36º 50,161’ N- 28º 00,111’ E) and Gerence Cape (36º 48,093’ N- 27º 59,518’E) (See: Map-14).

j) In Güllük Bay;

1) In Kazıklı Port, the area to the north-east of the line between Karaburun (37º 18,243’ N- 27º 25,926’ E) and Teke Cape (37º 15,100’ N- 27º 27,483’ E),

2) In Çam Port, the area to the north-east of the line between Teke Cape (37º 15,100’ N- 27º 27,483’ E) and İncegöl Cape (37º 13,827’ N- 27º 30,365’ E),

s3) In Asin Bay, the area to the north-east of the line between İncegöl Cape (37º 13,827’N- 27º 30,365’ E) and İnce Cape (37º 11,662’ N - 27º 31,631’ E),

4) The area to the east of the line between İnce Cape (37º 11,662’ N- 27º 31,631’ E) and Saplı Cape (37º 08,061’ N- 27º 24,777’ E) (See, Map-15).

k) In Köyceğiz Port, the area to the north of the line connecting Kızılburun (36º 47,205’ N- 28º 32,445’ E) and Bozburun (36º 45,614’ N- 28º 36,770’ E) (See, Map-16).

(4) In Mediterranean Sea:

All sorts of trawling are prohibited in:

Territorial waters between Antalya Province, Side District, Selimiye Lighthouse (36º 45,928’ N- 31º 23,092’ E) and Gazipaşa District, Kesik Cape (36º 09,964’ N- 32º 23,418’ E) (See, Map-17).

(5) With regard to the areas where all sorts of trawling are prohibited, entrance and exits are free for the purpose of passage from the shelters in prohibited areas to those shelters which are recognized by the Ministry.

Bottom Trawl Prohibition:

Article-4

(1) The bottom trawl prohibitions in terms of region, time and quality are given below:

a) Bottom trawling is prohibited in areas specified in Article-3.

b) Between 15th April- 25th September in territorial waters where trawling is permitted;

c) In territorial waters of Black Sea where trawling is permitted, bottom trawling is prohibited within 3 miles off the coast.

ç) In Aegean Sea, bottom trawling is prohibited;

1)Within 3 miles off the coast between the mouth of the Meriç River and Boztepe Cape (40º 37,140’ N- 26º 04,403’ E),

2) In Gökçeada; in the northern part of the Island, within 1,5 miles off the coast between Kömür Cape (40º 09,524’ N - 25º 40,588’ E) and Kaşkaval Cape (40º 14,479’ N- 25º 56,556’ E), and within 3 miles at the other parts of the island,

3) In the territorial waters of Bozcaada, within 3 miles off the coast (See, Map-18),

4) In the territorial waters between Çeşme Karaabdullah Cape (38º 15,955’ N - 26º 14,373’ E) and Sığacık Teke Cape (38º 06,356’ N – 26º 35,620’ E), within 3 miles off the coast (See, Map-19).

5) In other areas than specified herein, bottom trawling is prohibited in Aegean within the territorial waters 1.5 miles off the coast.

6) In Güllük Bay;

In the area to the east of the line between Tekağaç Cape (37º 21,340’ N- 27º 11,643’ E) and Kızılyar Cape (37º 09’508 N- 27º 19,358’ E), bottom trawling is prohibited between 1st December-15th February (See, Map-20).

7) In Aydın Province, Dilek Cape; bottom trawling is permitted out of 200 meters off coast between Zeytin Cape (37º 41,256’ N- 27º 03,930’ E) and Tavşan Island (37º 39,057’ N- 27º 00,058’ E) as long as time prohibitions are respected (See, Map-21).

d) In Mediterranean Sea;

Bottom trawling is prohibited,

(1) Within 1,5 miles off the coast in the territorial waters between

Antalya Province, Gazipaşa District, Kesik Cape (36º 09,964’ N - 32º 23,418’ E) and Kızılliman Cape (36º 04,243’ N - 33º 04,708’ E),

(2) Within 3 miles off the coast in the territorial waters between İncekumburnu (36º 14,044’ N - 33º 56,979’ E) Susanoğlu-Atakent (36º 24,971’ N - 34º 05,458’ E),

(3) Within 3 miles off the coast in the territorial waters between Mersin Karaduvar Shelter (36º 48,546’ N - 34º 41,873’ E) and the mouth of Ceyhan River (36º 34,101’ N - 35º 33,385’ E),

(4) Within 1 mile off the coast in the territorial waters between Akıncı Cape (36º 18,456’ N - 35º 46,745’ E) and Syria Border,

(5) In other territorial waters in Mediterranean than specified herein, bottom trawling is prohibited during the fishing year within 2 miles off the coast (See, Map-22).

e) Bunt mesh size of the bottom trawl nets to be used in Mediterranean and Aegean shall be 44 mm at minimum, and the outer wall of the bunt shall not have a mesh size smaller than 88 mm.

f) Bottom trawling is prohibited in the Black Sea with nets of a bunt mesh size smaller than 40 mm, and with nets having an outer bunt wall smaller than 80 mm. in mesh size.

g) Use of nets in bottom trawl nets with mesh size smaller than bunt mesh size is prohibited.

ğ) Using “nets of fishing line” (single - fishing line) in the bunt of bottom trawl nets is prohibited.

h) Bottom trawl nets with a mesh size smaller than the minimum measures are prohibited in the ships, and hauling of bottom trawl nets by more than one ship is also prohibited.

i) Bottom trawling in waters with 1000 m depth or more is prohibited.

(2)       At times and in places where trawling is prohibited, trawl nets may be transported in stalls in the vessels. Trawl doors shall not be kept in hanging position. It is obligatory that the places where the doors are hanging (Davit) face inside of the ship.

(3)  It is obligatory that the trawl vessels to pass through Marmara Sea have their nets and doors sealed during their passage from Bosphorus and Dardanelles Straits to the Marmara Sea, as per the principles to be specified by Çanakkale and Istanbul Provincial Administrations. The nets shall be kept in the hold, and doors on the deck or in the hold.

(4) The sealing procedures of the bottom trawl vessels to pass through Bosphorus Strait shall be fulfilled in Büyükdere.

(5) The trawl ships departing from Marmara Sea and sailing to other territorial waters of our country for trawling shall apply the nearest provincial or district administration for having their nets and doors sealed.

Midwater Trawl Prohibition

Article-5:

(1)Midwater trawling is prohibited in Marmara Sea, Aegean Sea and Mediterranean Sea, and in areas where all sorts of trawling are prohibited in the Black Sea.

(2)Towing of midwater trawl in waters shallower than 18 m (10 fathoms) and using it for fisheries procurement are prohibited in Black Sea during 15th April - 15th September. However, sprat landing with midwater trawl is permitted in 15th April- 15st May in 20 fathom and deeper waters between Samsun Province, Yakakent District, Çayağzı Cape (41º 41,040’ N - 35º 25,193’ E) and Akçay mouth in Samsun-Ordu Province border (41º 08,874’ N - 37º 10,112’ E) on condition that it is towed by two boats (See, Map-23). “Fishing Permit”, given in Annex-1, from Samsun Provincial Administration for the vessels to benefit from such exception and “Certificate of Origin for Fisheries”, given in Annex-3, for the sprat caught shall be required.

SECTION TWO
Prohibitions of the Species and Length

Prohibited Species and Genera

Article-6:

Catching or collecting of the species given in following table is prohibited in all waters including inland waters. Exceptions provided under international contracts we are party to are excluded from the scope of this regulation hereby.

Shrimping

Article-7

(1)Time, place and gear prohibitions for shrimping are given below:

a) Shear legs are prohibited in all territorial waters and in Bosphorus and Dardanelles Straits, except for Marmara Sea.

b) Shrimping with all types of gears is prohibited in Marmara Sea and Bosphorus and Dardanelles Straits in 15th April – 31st August and 1st - 31st January. However, caramote prawn (P. Kerathurus) shrimping with gillnets is permitted in 1st June – 15th July.

c) During the periods when landing activities are permitted in Marmara Sea, in areas specified in Annex-2;

1) Deep water pink shrimp landing is permitted in waters deeper than 50 m. with 2 double-bunt shrimp trawls whose total beam length is no higher than 15m. or 3 single-bunt shear legs each of whose total beam length is no higher than 5 m, having a mouth of 50 cm. high, shoulder mesh size and bunt mesh size of 32 mm. at minimum, and a bunt length of 6 fathom (11 m) at maximum. Use of steel rope is prohibited in shrimp landing with shear legs. The diameter of the ropes to be used can not be ticker than 16 mm.

2) Bunt mesh size of manyats to be used in prawns landing can not be smaller than 28 mm. On the other hand, use of manyat with a bunt mesh size smaller than 32 mm shall be prohibited as of 1st September 2007

ç) “Fishing Permit” given in Annex-1 shall be required to be obtained from the provincial administration which grants vessel’s license, for the fishing boats to shrimp with manyat and shear legs.

d) “Certificates of Origin for Fisheries” given in Annex-3 shall be required for the harvested shrimps and they shall be landed in the places to be decided and announced by the provincial administrations.

(2)All methods of shrimping with any type of gears except for gillnets are prohibited in Mediterranean sea within;

a) 1,5 miles off the coast in the territorial waters between Antalya Province, Gazipaşa District, Kesik Cape (36º 09,964’ N - 32º 23,418’ E) and Kızılliman Cape (36º 04,243’ N - 33º 04,708’ E),

b) 3 miles off the coast in the territorial waters between İncekumburnu (36º 14,10’ N - 33º 56,90’ E) and Susanoğlu-Atakent,

c) 3 miles off the coast in the territorial waters between Mersin Karaduvar Shelter (36º 48,546’ N - 34º 41,873’ E) and mouth of Ceyhun River,

ç) 1 mile off the coast in the territorial waters between Akıncı Cape and Syrian border

d) 2 miles off the coast in other territorial waters in Mediterranean than specified herein.

(3) In Mediterranean Sea, shrimp trawling shall be performed in the permitted times and zones on condition that;

a) The nets are no longer than 22m in total, with a bunt length of 5m, tunnel and shoulder of 8m., and wings of 9m. at maximum,

b) Bunt mesh size is 44 mm, the mesh size of the outer wall of bunt is 96 mm, tunnel and shoulder mesh size 56 mm, and wing mesh size 96 mm., at minimum,

c) Rope to be used between the doors and slips has no weights, and nets are no longer than 26 m.

(4) All methods of shrimping with any type of gears except for gillnets are prohibited in Mediterranean and Aegean between 15th April-15th September.

Sea Shell and Sea Cucumber Landing

Article-8

(1) Sea Shell

a) In Black Sea, seashell landing is prohibited in the territorial waters between Rumelian Karaburun in the opening of the Bosphorus Strait and Anatolian Karaburun.

Seashell harvesting through diving and basket method, and all kinds of trap methods is permitted in the other territorial waters.

b) Seashell harvesting with shear legs is prohibited in Marmara Sea and Bosphorus and Dardanelles Straits during the fishing year, and in other territorial waters between 1st May – 31st August.

c) Shear legs to be used for sea shell harvesting shall have a mouth width of 3 m. at maximum, a mouth depth of 40 cm. at maximum, bunt length of 1 m. at maximum, and a bunt mesh size of 90 mm.

ç)   Seashell harvesting shall be performed only between sunrise and sunset.

d) Seashell harvesting with shear legs is not prohibited within 500 m. off the coast.

e) No more than 1 shear leg can be kept and used in a vessel.

f) “Fishing Permit” given in Annex-1 shall be required from the provincial administration authorizing vessel’s license, for the fishing boats to perform seashell harvesting.

g) Spears are prohibited in the fishing boats to perform seashell harvesting.

(2) Sea Cucumber

a) In all territorial waters, sea cucumber harvesting with shear legs is prohibited during the fishing year. On the other hand, sea cucumber harvesting may be performed in Marmara Sea during the period and under the conditions which the shrimping with shear legs is permitted.

b) Diving for sea cucumber is permitted outside the period of 1st August - 15th September on condition that the authorization is granted by the provincial administration. “Fishing Permit” given in Annex-1 is required to be obtained from the provincial administration authorizing ship’s license, for the fishing boats to harvest sea cucumber.

c) In all territorial waters, sea cucumber harvesting is completely prohibited as of September 15th 2007.

Crawfish, Lobster, Octopus and Blue Crab Harvesting

Article-9

(1) Harvesting of crawfish and lobster is permitted in all territorial waters only in the term between 15th April – 15th June.

Harvesting of mantis shrimp is permitted in territorial waters between Antalya Province, Kaş District, Kalkan – İnceburun (36º 13,525’ N - 29º 24,860’ E) and Uluburun (36º 07,899’ N - 29º 41,004’ E) only between 15th April-15th June. For mantis shrimp, “Certificate of Origin for Fisheries” given in Annex-3 shall be obtained from District Administration of Kaş.

(2) Harvesting of octopus (O.vulgaris) is prohibited in all territorial waters in 1st May – 31st October.

(3) In Mediterranean Sea, blue crab harvesting is prohibited in 1st May – 1st October. However, blue crab harvesting can be performed in coastal lagoons at appropriate times specified by the provincial administrations.

Bivalve Mollusks Harvesting

Article-10

(1) Striped Venus

All methods of striped venus harvesting with any gears are prohibited in;

a) Marmara Sea and Bosphorus and Dardanelles Straits,

b) In the territorial waters between Bulgarian border and Kocaeli Province, Kefken Island Lighthouse (41º 13,017’ N – 30º 15,076’ E),

c) In the territorial waters between Bartın Province, Tosun Cape (41º 52,000’ N – 32º 52,271’ E) and Samsun Province, Yakakent District, Çayağzı Cape (41º 41,040’ N – 35º 25,193’ E),

ç) In the territorial waters between mouth of Akçay River in Samsun-Ordu Province border (41º 08,874’ N - 37º 10,112’ E) and Georgian Border,

d) And, between 1st May - 31st August in areas other than the prohibited areas (See, Map-24).

d) And, between 1st May - 31st August in areas other than the prohibited areas. However, in case catch quota for the cockle has been fulfilled, the Ministry has the authority to extend the period of the ban. (Changed Official Journal  23.05.2007-26350) (See, Map-24)

e) Shear legs and dredges used for striped venus landing shall be;

1) no higher than 80 cm and deeper than 20 cm. in the mouth, and no more than 200 cm in bunt length. Hydraulic dredges shall be no higher than 350 cm in the mouth and no more than 300 nm in length.  

2) The spacing between metal bars in dredges and sieves shall not be shorter than 9.5 mm.

f) All methods of striped venus harvesting are prohibited in waters shallower than 5m.

g) For striped venus claming with shear legs and dredges, no more than 1 shear leg and dredge shall be kept or used in vessels.

ğ) “Fishing Permit” given in Annex-1 shall be required from the Provincial Administration authorizing ship’s license, for the fishing boats to clam striped venus.

h) When harvesting Cardium edule and C. lamarki, regulations stipulated for harvesting of striped venus shall apply.

(2) Golden Carpet-Shell and Warty Venus

a) All methods of golden carpet-shell and warty venus harvesting with any gears are prohibited in all territorial waters in 15th May – 15th September.

b) For sieves used for golden carpet-shell harvesting, sieve mesh size shall be minimum 24 mm. and in those used for warty venus harvesting, it shall be minimum 30 mm.

(3) Oyster and Great Scallop Harvesting:

All methods of oyster and great scallop harvesting with gears are prohibited in all territorial waters in 15th May – 15th September.

(4) Mediterranean Mussel and Bearded Horse-Mussel:

a) Mediterranean mussel and bearded horse-mussel harvesting is prohibited in Bosphorus Strait in the area between the line connecting Ahırkapı (41º 00’ 27” N - 28º 95’ 05” E) - Kadıköy İnci Cape Mole Lighthouse (40º 59’ 05” N - 29º 00’ 52” E) and the line connecting Yeniköy Port (41º 07’ 01” N - 29º 04’ 18” E) – Paşabahçe Lighthouse (41º 06’ 57” N - 29º 05’ 23” E) (See: Map, 25).

b) In Dardanelles Strait in the area to the east of the line between Nara Cape Lighthouse (40º 11, 823’ N- 26º 24, 093’ E) and Kepez Lighthouse (Kanlıdere) (40º 05, 506’ N - 26º 21, 816’ E) (See, Map- 26),

c) In the free zones of the Bosphorus Strait and the other territorial waters Mediterranean mussel and bearded horse-mussel harvesting is prohibited in 1st May – 30th June.

 (5) Tellina:

a) Tellina harvesting is prohibited in the Black Sea and Marmara Sea during the fishing year.

b) In Mediterranean and the Aegean Sea only tellina harvesting through diving is permitted, except for the 1st May – 15th July period.

b) In Mediterranean and the Aegean Sea only tellina harvesting through diving and collecting is permitted, except for the 1st May – 15th July period. (Changed Official Journal  23.05.2007-26350)

(6) Striped venus, golden carpet-shell, warty venus, oyster and tellina, of which the stocks are detected by the provincial administrations from the enforcement date of the prohibition, shall be processed or shipped no later than the 10th day of enforcement.

This period shall be determined by the Ministry for the living bivalve mollusks in the refinement center approved by the Ministry.

(7) Bivalve mollusks harvesting is prohibited in bivalve mollusks production areas closed to product intake because of non-complying analysis results obtained in monitoring and routine program and the areas that are open in the scope of Circular and where monitoring and routine programs are not applied.

Turbot, Swordfish, Grouper, Golden Grouper, Sole and Sand Dab Landing

Article-11:

(1) All methods of turbot landing in the territorial waters are prohibited in 1st May – 30th June.

a)Turbot capture with set longline and trammel nets is prohibited during the term.

b) Turbots, caught before the prohibited season and whose stock register is made in the provincial or district directorates, shall be marketed in maximum 7 days after the prohibition starts.

(2) All methods of swordfish landing is prohibited in 1st October – 31st January.

It is mandatory for the fishing vessels longer than 12 m. which will catch swordfish to obtain "Fishing Permit" given in annex-1 from the provincial directorate issuing vessel's license. (Changed Official Journal  23.05.2007-26350)

(3) All methods of sole and sand dab landing are prohibited in 15th February – 15th March.

(4) Mesh size of the nets to be used for sole and sand dab catch shall be no less than 72 mm till September 1st, 2007 and be no less than 80 mm after that time.

(5) All methods of grouper and golden grouper landing is prohibited in 15th June - 31st July. However, golden grouper catch with set longline is permitted during the said period on condition that the used fishhook is smaller than no: 9 (larger in size).

(6) Grouper and golden grouper landing through diving, with fish spear or underwater rifle, and traps like basket, pinter (some kind of basket) etc. is prohibited.

Bonito, Large Bonito, Tuna Fish, Little Tunny, Albacore, Plain Bonito, Leer Fish, Greater Amberjack and Pilchard Landing

Article-12:

(1) Bonito – Large Bonito:

In Marmara See, large bonito (longer than 45 cm) landing is prohibited in the term 1st December – 31st August. All methods of bonito and large bonito landing, including stake nets, in the territorial waters are prohibited in the term 1st April - 31st August. However, longlining for bonito is permitted in 15th - 31st August.

(1) Bonito – Large Bonito:

In Marmara See, large bonito (longer than 45 cm) landing is prohibited in the term 1st December – 31st August. All methods of bonito and large bonito landing, including stake nets, in the territorial waters are prohibited in the term 1st April - 31st August. However, longlining for bonito is permitted in 15th - 31st August.

Bonito and large bonito fishing by all kinds of gears including stake nets is banned between 1 April – 31 August throughout all our territorial waters. However, longlining for bonito is permitted between 15-31 August.. (Changed Official Journal 23.05.2007-26350)

(2) Blue fin-tuna;

a) Blue-fin tuna landing in all territorial waters is prohibited in 16th July – 15th August. However, the Ministry is authorized to extend the prohibition term in the case that the blue-fin tuna landing quota offered to Turkey by ICCAT (International Commission for the Conservation of Atlantic Tunas) reaches the top.

b) A “Tuna Landing Permit” - the form and content of which will be determined by the Ministry - shall be required from the provincial administration authorizing ship’s license, for the fishing boats to harvest tuna. And, a “Tuna Transport Permit” shall be required from the provincial administration of the city the ship is in, for the ships to transport tuna.

a) Tuna fishing by purse seine between 1 July-31 December, by longline vessels whose length is 24 m and over between 1 June - 31 December, and by feeding method between 15 November - 15 May is prohibited throughout all our territorial waters. However, in case the catch quota allocated for our country by the International Commission for the conservation of Atlantic Tunas (ICCAT) has been fulfilled, the Ministry has the authority to extend the subject periods of ban.(Changed Official Journal  23.05.2007-26350)

b) It is mandatory for tuna fishing vessels to obtain “Fishing Permit for Tuna”, the form and content of which is determined by the Ministry, from the provincial directorate issuing vessel’s license and it is mandatory for the carrier boats to perform carrying activities related tuna catch to obtain “Permit for Carrying Activities concerning Tuna Fish” from the provincial directorate in the same location as the vessel, for during the periods when using purse seine is allowed for tuna fishing exceptionally. c) The fishing boats to harvest tuna shall be equipped with a functioning vehicle phone and a fax machine.

ç) To monitor and supervise fishing quota, the catch amount and coordinations of catch area shall be notified to the Ministry via the fax machine of the vessel, just after each fishing operation.

d) In case of a possible failure in fax machine, notifications made from other fax machines, without duly informing the Ministry, shall be rejected.

e) Fishing vessels shall be taken to shelters and ports in maximum 3 days following the closure of blue-fin tuna fishing season which will be announced by the Ministry. Closest provincial or district administration shall be notified about the vessels to have come to port.

Vessels to transport blue-fin tuna shall notify the Ministry about their current location; final destination; planned arrival time; and the amount of product they transport in cages.

f) After transport procedures of blue-fin tuna caught are completed, detection of fish in the farms shall be made by provincial administrations. In case detection of unrecorded fish, said fish shall be released.

g) Vessels to have obtained “Tuna Landing Permit” shall not be given a permit for any other type of fishing activity till 16th July.

Landing Permits of vessels failing to comply with permit conditions shall be intercepted and sent for annulment to provincial administration to have issued the said permit. No new permit shall be issued for these vessels for the year concerned.

g) The fishing permits regarding tuna catch of the vessels which do not comply with the conditions specified therein shall be seized and submitted for cancellation to the provincial directorate issuing the subject permit. No other fishing permit shall be issued for those vessels for that year. (Changed Official Journal  23.05.2007-26350)

ğ)   Each vessel with a “Tuna Landing Permit” shall be liable to keep records demanded by the Ministry about the tuna amounts it has caught and sold, and to comply with the regulations made in this respect.

h) “Certificate of Origin for Fisheries” and “Health Certificate” shall not be issued for the amounts caught in fishing season but not informed to the Ministry and for the amounts caught after the closure of fishing season. These said amounts shall be released if alive and shall be seized if dead.

ı)Mesh size in the bag part of the blue-fin tuna nets shall be no less than 44 mm.

i) Regarding tuna fishing, use of airplanes or helicopters for the purpose of searching for tuna is prohibited. (Changed Official Journal  23.05.2007-26350)

j) Catching, retaining on board, transshipment, landing, transport, storing and sales of tuna weighing less than 10 kg is prohibited. (Changed Official Journal  23.05.2007-26350)

(3) Little tunny, Plain bonito, Leer fish, Greater Amberjack and Albacore:

a)Little tunny, albacore, plain bonito, leer fish and greater amberjack landing is permitted in the territorial waters between Mıhlı Stream (39º 33,209’ N- 26º 39,472’ E) and Syrian border in 15th April – 15th May. “Fishing Permit” given in Annex-1 required from the provincial administration authorizing ship’s license, for the fishing boats to make use of the exception. Products caught shall be landed on the areas stated in Annex-5 or areas to be decided by the Ministry, and “Certificate of Origin for Fisheries” given in Annex-3 shall be issued for these amounts concerned.

a) Fishing little tunny, albacore, plain bonito, leer fish and greater amberjack by entangling net is permitted during the season throughout our territorial waters and by purse seine from 15 April to 15 May in the territorial waters between Mıhlı creek (39° 33,209’ N- 26° 39,472’ E) and Syrian border. It is mandatory for the purse seiners who will benefit from this exception to obtain "Fishing Permit" given in annex-1 from the provincial directorates issuing vessel's license, to land the catches on the points specified in annex-5 or on the points to be determined by the Ministry and to obtain the arranged “Certificate of Origin” given in annex-3, as well. b) In Aegean Sea, little tunny, albacore, plain bonito, leer fish and greater amberjack landings are prohibited in the territorial waters to the east of the line between the mouth of River Meriç and Boztepe Cape (40º 37,140’ N- 26º 04,403’ E), Büyük Kemikli Cape (40º 18,979’ N- 26º 12,905’ E), Bozcaada West Cape (39º 50,259’ N- 25º 57,754’ E), Babakale (39º 28,772’ N- 26º 04,013’ E), and Mıhlı Stream (39º 33,209’ N- 26º 39,472’ E), in 15th April – 31st August.

(4) Pilchard gillnetting is permitted during the term.

(5) In Muğla Province, Gökova and Güllük Bays, setting leer fish and bonito nets in water between 07.00 – 19.00 hours is prohibited.

Algae Harvesting

Article-13

(1) Collecting, harvesting and selling of Caulerpa species of alga are prohibited in all territorial waters.

(2) Harvesting of Gracilaria species of alga is prohibited in all territorial waters in 1st April – 15th July. Harvesting within the permitted period shall be performed, upon the permission from provincial administrations, in turn so that at least 1/3 will be able to sporulate.

Sponge Harvesting

Article-14

(1) Sponge harvesting is prohibited during the fishing year in all territorial waters.

Prohibitions of Length and Weight

Article-16

(1) Harvesting of fisheries by purse seines is prohibited in;

a) In Bosphorus Strait, the area between the line connecting Ahırkapı (41º 00’ 27” N - 28º 59’ 05” E) and Kadıköy İnci Cape Mole Lighthouse (40º 59’ 05” N - 29º 00’ 52” E), and the line connecting Yeniköy Port (41º 07’ 01” N - 29º 04’ 18” E) and Paşabahçe Lighthouse (41º 06’ 57” N - 29º 05’ 23” E) (See, Map-27),

l) In Taşucu Bay, within the area to the north of the line between Güvercin Island (36º 14,716’ N - 33º 48,621’ E) and İncekumburnu (36º 14,090’ N - 33º 56,899’ E) (See, Map-36),

(2) Harvesting of fisheries by purse seines is prohibited in all seas in the term 15th April – 31st August.

(3) In the territorial waters within the area between the Mıhlı Stream and Syrian border in 15th April – 15th May, harvesting of Little Tunny, Albacore, Plain Bonito, Leer Fish and Greater Ambercek by purse seines is permitted.

(4) Unless a prohibition is implemented in all territorial waters as the tuna landing quota offered to Turkey by ICCAT (International Commission for the Conservation of Atlantic Tunas) reaches the top in the term between 15th April – 15th July and 16th– 31st August, harvesting of tuna fish by purse seines is permitted.

(5) Use of purse seines with a depth of more than 90 fathoms, except the purse seines used in tuna fishing, shall be prohibited.

(6) Fishing with not pursing cast nets is permitted during the fishing year up to 12 fathom deep, with or without trammel net, without eyebolt and wire,

(7) In all territorial waters purse seining is prohibited in waters shallower than 10 fathom (18 m). However, purse seining in waters up to 6 fathom deep (11 m) is permitted in the territorial waters in Black Sea between Köpekkaya Cape in Cide District of Kastamonu Province and Bulgarian border, and in the Marmara Sea in 1st September – 1st December. In Mediterranean, purse seining in waters up to 6 fathom deep (11 m) is permitted in the territorial waters between the mouth of Seyhan River and Susanoğlu-Atakent.

Harvesting with surrounding nets (purse seines and cats nets) is prohibited in Mediterranean:

a) In the territorial waters between the mouth of Seyhan River and Yumurtalık Shelter, in waters shallower than 10 fathom (18 m),

b) In the territorial waters between Yumurtalık Shelter and Akıncı Cape, in waters shallower than 8 fathom (14 m).

Harvesting with purse seines is prohibited in Mediterranean

a) In the territorial waters between the mouth of Seyhan River and Yumurtalık Shelter, in waters shallower than 10 fathom (18 m),

b) In the territorial waters between Yumurtalık Shelter and Akıncı Cape, in waters shallower than 8 fathom (14 m). (Changed Official Journal  23.05.2007-26350)

Light Fishing

Article-17

(1) Using light for fishing is prohibited in following areas:

a) In the Marmara Sea, the Bosphorus and Dardanelles Straits,

b) In Izmir Bay, in the territorial waters to the south of the line between Ardıç Cape (38º 31,955’ N - 26º 37,525’ E) and Kapan Cape (38º 32,689’ N - 26º 48,880’ E) (See, Map-37),

c) In Ildır Bay, in the area to the south-east of the line between Dalyanköy Cape (38º 20,790’ N - 26º 19,462’ E) and Kiraz Cape (38º 25,675’ N - 26º 27,107’ E) and coordinate point (38º26,972’ N - 26º29,453’ E) (See, Map-38),

ç) In Mediterranean, in the territorial waters between Anamur Cape and Syrian border,

e) In Aegean,

1) In the area to the east of the line between Edirne Province, Boztepe Cape (40º 37,140’ N - 26º 04,403’ E) and Çanakkale Province, Büyük Kemikli Cape (40º 18,979’ N - 26º 12,905’ E), Gökçeada Aydıncık Cape (40º 09,801’ N - 26º 00,554’ E), Bozcaada West Cape (39º 50,259’ N - 25º 57,754’ E),

4) In the area to the east of the line between Küçükkuyu Shelter (39º 22,781’ N - 26º 36,421’ E) and Küçük Maden Island (39º 23,135’ N - 26º 34,119’ E), Güneş Island Lighthouse (39º 19,736’ N - 26º 32,441’ E), Çıplak Island Yumru Cape (39º 16,722’ N - 26º 34,653’ E) and Eğribucak Cape (39º 16,399’ N - 26º 36,589’ E) (See, Map-41),

e) In Asin Bay, the area to the north-east of the line between İncegöl Cape (37º 13,827’ N - 27º 30,365’ E) and İnce Cape (37º 11,662’ N - 27º 31,631’ E) (See, Map-42),

(2) In the territorial water between the mouth of Meriç River and Anamur Cape on the term between 15th April – 31st August.

(3) For the vessels to pass trough Marmara Sea, Bosporus and Dardanelles Straits with the aim of light fishing in other territorial waters, it shall be obligatory to obtain “Transit Pass” given in Annex-4 from the Provincial or District Administration closest to the ship, as long as transit pass route is notified, and the transit pass from concerned locations shall be performed in 3 days, at the latest.

(4) Out of the fishing team of ships to perform light fishing, only one ship shall have the light source.

(5) “Fishing Permit” given in Annex-1 is required from the provincial administration of the harvesting zone for the fishing boats to use light for fishing.

(6) Use of lighting power up to 100 Watts is not bound to the permission. Total lighting power of the main boat, accompanying boats and carrier boats shall not exceed 8000 Watts, in the areas where light fishing is permitted.

(7) Enlightening shall only take place above the water in light fishing.

(8) It is compulsory to appoint a staff in lighting boats and a minimum 200 m distance shall remain between the lighting boats of two different teams.

(9) Lighting is prohibited in waters shallower than 30 m and 500 meters off cages belonging to fish farms.

(10).A 12 or 24 V blinking single lamp with a power less than 100 Watts for stopping the surrounded fish run away from the opening of the net in purse seining does not count for light source.

(11) Service boats in purse seiners can be used as lighting boats.

Seine nets, Gillnets and Other Fishing Nets

Article-18

1) All sorts of seining with ığrıp (2), trata (3), tarlakoz (4), manyat (5) and other beach seines are prohibited in all territorial waters. These seine nets and the equipment enabling their usage are prohibited in fishing vessels.

2) Landings with manyat are permitted outside the 1st April – 31st August period in the areas to be specified by the provincial administrations of Paşabahçe, Küçüksu, Vaniköy, Ortaköy, İstinye Tokmak Cape, Tuzla Karaaslan (Şıkır), Kumlar, Yalakdere, Yalova, Esenköy, Çınarcık, Kireçburnu, Kumburnu, Çınarkoy, and in the marine zone of 250 m. radius in Kepez Coastal Lagoon Cape (Akıntı Cape) and Namazgah Cape (Kilitbahir Lighthouse) in Dardanelles. “Fishing Permit” given in Annex-1 shall be required from the provincial administration of the harvesting zone, for the fishing boats to perform harvesting efforts in the said areas.

3) In Marmara Sea, shrimping with the type of manyat specifically employed for such purpose is permitted on condition of full compliance with the regulations on shrimping.

4) In Aegean Sea, fishing with haul nets (trata) is permitted in the area to the east of the line between Eğribucak Cape (39º 16,399’ N - 26º 36,589’ E) Babakale (39º 28,772’ N - 26º 04,013’ E), except 1st April – 15th July.

5) Bunt mesh size of nets to be used in haul nets shall not be smaller than 24 mm and, use of more than 4 ropes (400 m) and fishing with vessels longer than 10 meters shall be prohibited.

6) “Fishing Permit” given in Annex-1 shall be required from Balıkesir Provincial Administration, for the fishing boats to perform fishing by haul nets.

7) In cast net areas specified by the provincial administrations, harvesting with seine nets such as ığrıp (beach seine), manyat and tarlakoz (pair seine) and all sorts gillnetting in a way to prevent harvesting are prohibited.

8) In the Aegean Sea and Mediterranean, all and any captures by shear legs are prohibited.

9) In grey mullet harvesting through reed-nets, mesh size of the nets horizontally positioned by the help of the reeds on the sea surface shall be 48 mm. at minimum.

10) All sorts of set nets and spearing are prohibited - taking as basis the mouths of Solaklı Stream, Baltacı Stream (Of), İyidere Stream, Büyükçay Stream (Çayeli), Fırtına Stream (Ardeşen), Çağlayan Stream (Fındıklı), Kapisre Stream (Arhavi), Hopa Stream and Osmaniye Stream (Kemalpaşa) - in the area connecting 1 km. off both sides (east and west) of rivers and 500 m. off the sea in the term between 1st April – 30th June, between Trabzon province, Of District, Solaklı Stream and Sarp Border Crossing .

SECTION FOUR
Measures to be Taken in Lagoons and Coastal Lagoons

Harvesting in Lagoons and Coastal Lagoons

ARTICLE-19

(1) Openings of lagoons and coastal lagoons shall be freed during the time specified by the Provincial Administrations when grey mullets migrate to the sea to lay eggs, or to the freshwaters for food.

It is obligatory to set free 10% of the grey mullets with eggs which have reached the lagoons and crawls of coastal lagoons under the supervision of the officials of the provincial administration.

(2) Fence spacing of weirs in the lagoons and crawls of coastal lagoons shall not be, in vertical position, less than 1.7 cm. in the Mediterranean lagoons and coastal lagoons (from Yardımcı Cape to Syrian border) and less than 3 cm. in other lagoons and coastal lagoons.

(3) During the dates when openings of lagoons and coastal lagoons are freed, harvesting of fisheries other than those permitted by the Ministry is prohibited within 1 mile off the opening, and within 500 m. radius when closed.

(4) Harvesting of fisheries is prohibited in the area 1000 m. off the line connecting the both moles in the Beymelek Lagoon in Kale District of Antalya Province.

(5) In lagoons and coastal lagoons in Bafa, Kapıkargın and Köyceğiz, harvesting of fisheries is prohibited within 2 miles radius off the opening of the lagoon coast.

a) Harvesting of all sorts of fisheries, excluding eel, is prohibited in Bafa lagoon in 1st May – 31st July.

(5) In lagoons and coastal lagoons in Bafa and Kapıkargın, harvesting of fisheries is prohibited within 2 miles radius off the opening of the lagoon coast.

a) Harvesting of all sorts of fisheries, excluding eel, is prohibited in Bafa lagoon in 1st May – 31st July.

b) Fishery production is prohibited in the area east of the line which connects the coordinates of Akiye cape (36° 47,945’ N- 28° 35,671’ E) and of the ring reef Zeytin Horozu on Kamışlı shore (36° 46,320’ N-28° 37,070’ E) in the region of İztuzu coast where the channel connecting Köyceğiz lagoon to the Mediterranean Sea starts. (6) Setting gillnets within 500 m. off drop-net fishponds is prohibited in 08:00 – 13:00 hours.

(7) Permission is required from the Ministry for use of lift nets and harvesting activities.

(8) Spearing and use of light for harvesting fisheries are prohibited in lagoons.

(9) Setting new coastal lagoons other than those already functioning on permission is not allowed. Coastal lagoons which have already been set upon the permission of the Ministry are not allowed to be used and operated as şıra net.

(10) Lagoons shall comply with species, size and time prohibitions defined by this circular. 

SECTION FIVE
Region and Area Prohibitions

Area Prohibitions

ARTICLE-20

(1) Followings are the general area prohibitions;

a) I (a) group mine extraction in the areas specified as Caretta caretta breeding zone (MUĞLA – Dalyan, Ekincik, Dalaman, Fethiye – Çalış; ANTALYA – Patara, Demre, Kumluca, Tekirova, Belek, Kızılot, Gazipaşa, Demirtaş; IÇEL – Anamur, Kazanlı, Göksu Delta; ADANA – Akyatan; HATAY – Samandağ) is prohibited in 1st April – 30th September and speedy navigation over 5 miles of the speed boats is prohibited within 1 mile off the shore. Necessary protection measures shall be taken by the related Provincial Administrations within the breeding periods of caretta carettas.

b) Harvesting of fisheries through diving in the regions the coordinates of which were published in the Official Gazette no: 24533 on 24th September 2001, which were specified by the Ministry of Culture within the framework of preserving cultural and natural assets.

c) Use of light and diving with any equipment are prohibited in caves where seals live.

d) Bottom trawling is prohibited within 100 m. off the cables at the right and left sides, on the routes which submarine cables Turmeos I and Turcyos I are laid.

(2) Followings are the area prohibitions in Mediterranean:

a) In Mediterranean Sea; shark harvesting between Eşen Stream and Anamur Cape in 1 April – 30 October is prohibited.

b) All and any harvesting of fisheries with fish spear are prohibited 500 m off the islands in the area of Üçadalar in Kemer District in Antalya.

c) Along the coastal line, 19 km. long line starting with Küçük Çavuş Cape in Çavuş Port of Kumluca District surrounding the south of Beydağları National Park in Antalya, covering Sulu Island, Taşlık Cape and Beş Islands, ending with Karagöz Port,

ç) In the area within the Mersin Harbour moles,

d) In the area within 200 m. off the coastal line in the Pullu forest recreational area in Anamur District of Mersin Province,

e) In Mersin Kızılliman site, within 200 m. off the shore between Arap Cape (36º 05’ 12” N - 33º 05’ 28” E), and Gökçevlik Site (36º 06’ 30” N - 33º 06’ 38” E);

f) Within 200 m. off the shore in 1 mile long coastal line with Karaağan Cape in Anamur District of Mersin province, in the center

g) Within 200 m. off the shore in the coastal line of Alata Horticultural Research Institute of the Ministry of Agriculture and Rural Affairs in Erdemli District of Mersin Province,

ğ) Within the territorial waters between Kızıl Port in Bozyazı District of Mersin Province (36° 04,243’ N - 33° 04,708’ E) and Sancak Cape in Aydıncık District of Mersin Province (36° 07,582’ N - 33° 23,261’ E) with all gears but gillnets and set longlines,

h) In the harbor within the boundaries of METU Institute of Marine Sciences and in the 500 m. wide area surrounding the harbor in Erdemli District of Mersin Province,

ı) In Adana Province, within the area to the west of the line between Kokar Cape and Yumurtalık Shelter with any gear but gillnets being excluded,

i) In the Special Security Zone of BOTAŞ Oil Loading Port in Ceyhun District of Adana Province (36º 52’ 08” N - 35º 55’ 06” E, 36º 50’ 30” N - 35º 56’ 02” E, 36º 51’ 30” N - 35º 58’ 24” E, 36º 53’ 24” N - 35º 56’ 42” E) and in the Special Security Zone of BOTAŞ Oil Loading Port in Dörtyol District (36º 50’ 55” N - 36º 07’ 24” E, 36º 50’ 55” N - 36º 08’ 40” E, 36º 51’ 54” N - 36º 07’ 24” E, 36º 51’ 54” N - 36º 08’ 40” E), within the area having the foregoing coordinates.

j) In Adana Province within the area between the inside of the Yumurtalık Shelter and Shelter Lighthouse Kale Security Complex,

l) In the area within the coordinates (36º 50’ 24” N - 35º 53’ 48” E), (36º 50’ 06” N - 35º 54’ 36” E), (36º 49’ 42” N - 35º 54’ 12” E), (36º 49’ 26” N - 35º 53’ 54” E), (36º 50’ 00” N - 35º 53’ 00” E), where Sugözü power plant is located, in Yumurtalık District of Adana Province,

all and any harvesting of fisheries is prohibited.

(3) Followings are the area prohibitions in Aegean Sea:

a) In 200 m. off the coastal line of the areas of Aydın Kuşadası Dilek Peninsula Coastal National Park from Dil Port in the south to Dip Cape in the west (including the Su Island and the surroundings of Tavşan Island), from Dip Port in the west to the mouth of Mersinli Stream in the north,

b) Within the coastal area of line between Gevrek Island (Prasa Island) in the Akbük Bay of Didim District in Aydın Province and Değirmen Bay with beach seines and surrounding nets on condition that entrance and exit for shelter is permitted in the prohibited zone,

c) In 1st April – 15th August in the area between the River Menderes and Menderes Discharge Channel, which connects Bafa lagoon to the sea, and the bridge on the Tuzburgazı – Akköy highway,

harvesting of fisheries is prohibited.

ç) All sorts of gears are prohibited in the domiciles of the fishermen in Kafa region of the River Büyük Menderes and the fishing boats in the region, during the prohibited times and zones. Entrance and exit of the fishing boats is permitted on condition of full compliance with the prohibitions.

d) Setting nets and building dams and weirs, etc. to prevent fishery products from passing and growing in all sections of the River Büyük Menderes and the Discharge Channel and the fresh water springs (azmak) fed thereby are prohibited.

e) In the coastal lagoon channel connecting Köyceğiz Lake in the Köyceğiz District in Muğla Province with the Mediterranean Sea, water skiing with speed boats, in 1st May – 31st August, turning on the lights in a way as to affect the channel, navigation of all boats in 21:00 – 05:00 hours, and the speedy navigation of the boats, authorized from relevant institutions, higher than 3 miles are all prohibited.

g) In Köyceğiz village and delta, grey mullet catch with nets is prohibited during the season.

ğ) During the season within 100 m. towards the sea in the both sides of Yalancıboğaz in Marmaris District in Muğla Province,

h) During the season in Ortaca District, Sülüngür Lake, crawl being excluded,

ı) During the season in Ölüdeniz Bay of Fethiye District,

i) Within the area east of line between the Kızılyar Cape (37° 09,508 N-27°19,358’ E) and Gemitaşı (37° 09, 088’ N-27°15,709’ E), Büyük Kiremit Island (37° 05,169’N - 27°12,834’ E), Çavuş Island (37° 02,981’ N-27°12,228’ E) and Karabakla Cape (37° 02,387’ N - 27° 13,812’ E) in Bodrum Peninsula in Muğla Province with all gears but gillnets and set longlines,

j) In the area to the east of the line between Bostanlı Sazburnu and Üçkuyular Port in İzmir Harbour on condition that entrance and exit are permitted in and from Bostanlı Shelter inside the prohibited zone,

k) In Izmir Gulf, with any type of dredges and rakes is prohibited in the area to the south of Ardıç Cape and Eskifener Cape,

l) In Sığacık Bay (from the area between Dalyan Cape and Minaretaşı), in the District of Seferihisar in Izmir Province, during the season,

m) In the territorial waters of Izmir Province, by means of baskets, up to 6 fathom (11 m) depth off the coast, on condition that the time prohibition of octopus harvesting is obeyed, in the area of the marine zone between the mouth of River Gediz in the north (38º 35’ 58” N, 26º 47’ 64” E) and the İsa Reis Cape of the Uzun Island (38º 32’ 88” N, 26º 41’ 81” E), and the line between Çil Azmak Cape (38º 27’ 02” N, 26º 54’ 16” E) and Uzun Island Kireç Cape (38º 27’ 60” N, 26º 44’ 45” E) in the south,

m) Fishing by fyke net (pinter) is prohibited in the waters deeper than 6 fathoms (11 m), at a distance from the coastline between Kapan cape in the north (38 32' 40" N - 26 48' 50" E) and Çilazmak cape in the south (38 27' 00" N – 26 54' 30" E) on condition that the time restriction imposed on octopus harvesting is observed in the territorial waters around İzmir.  (Changed Official Journal  23.05.2007-26350)

n) In Izmir Province, Karaburun Peninsula, Mordoğan Town, in the area up to 20 m. off the shore between Ardıç Cape and Ege University Agricultural Test Station (except the already functioning dropnet fishponds in Ayıbalığı Site),

o) Within connecting area of Foça Arslan Cape (38º 44,602’ N - 26º 44,435’ E) and (38º 44,533’ N - 26º 40,883’ E), (38º 39,6616’ N - 26º 39,996’ E) and Deveboynu Cape (38º 39,326’ N - 26º 43,370’ E) with all gears but gillnets and set longlines and net fishponds,

ö) In the area 1 mile in length and 200 m. in width, between the coast and the line connecting the coordinates (40º 14’ 36” N - 25º 54’ 18” E) and (40º 14’ 36” N - 25º 55’ 40” E) between Yelkenkaya and Yıldız Bay where Sea Park will be built in Gökçeada District of Çanakkale Province,

All and any harvesting of fisheries is prohibited.

p) Harvesting of fisheries with any gears is prohibited in the area to the east of the line connecting the first two passage lighthouses among those in the opening of the Dalyan Strait in Ayvalık Port of Balıkesir Province. On the other hand, mussel harvesting through diving and/or hand-picking is permitted within the area during the season, and harvesting is permitted with set longlines no: 10 or smaller, outside the season 1st May – 31st August.

(4) Followings are the area prohibitions in Marmara Sea:

a) On the coordinate point (40° 32’ 50” N - 27° 16’ 00” E) where Australian submarine (A-E 2) sank,

b) In 1st May – 30th September within 3 miles off the coast line between the mouth of Gönen Stream (40º 19’ 38” N - 27º 38’ 00” E), and Denizkent (40º 18’ 15” N - 27º 30’ 45” E) in Balıkesir Province,

c) in the area to the coast-side of the line between the Doğu Cape of Çınar Port in Erdek and the coordinates (40º 23’ 02” N - 27º 48’ 30” E) and Seyitgazi Cape,

ç) Within the sea area inside the line between Erdek Port, Seyitgazi Cape, Tavşanlı Island Cape, southern Cape of Zeytin Island and the port mole,

d) In the area connecting the following coordinates around İmralı Island: (40º 37’ 00” N - 28º 27’ 00” E), (40º 37’ 00” N - 28º 37’ 00” E), (40º 28’ 00” N - 28º 37’ 00” E), (40º 28’ 00” N - 28º 27’ 00” E),

e) In the 50 m. long sea area around Mudanya Municipality Port,

f) with shear legs, dredges, rakes and hydraulic systems in the territorial waters between Kelağra (Galere) Cape and Dalyan Cape (Kilyos opening) in Istanbul Province,

g) In the area up to the mouths of Alibeyköy and Kağıthane Streams from New Galata Bridge, in Haliç of Istanbul Province,

ğ) In the area within the lines connecting the coordinates (41º 03’ 58” N - 28º 15’ 05” E), (41º 03’ 30” N - 28º 11’ 28” E), (41º 03’ 13” N - 28º 11’ 27” E), (41º 02’ 59” N - 28º 11’ 25” E), (41º 02’ 51” N - 28º 10’ 57” E), (41º 03’ 12” N - 28º 10’ 51” E), where TPAO Northern Marmara Natural Gas Production Platform and related sea floor pipelines are located in Silivri District of Istanbul Province,

h) In Yalova District, within 200 m. off the sea at the right and left side of the municipality sewerage system,

ı) within 500 m. off the coast in the area between Yalova Province, Altınova District, Hersek Cape and Kocaeli Province, Karamürsel District, Büyükdere Cape,

i) Within 500 m. off the sea at the right and left sides of the sewerage system of the municipality in Altınova offings in Tekirdağ Province,

j) In the area within the lines connecting the coordinates (40º 58’ 00” N - 27º 58’ 06” E), (40º 58’ 00” N - 28º 00’ 24” E), (41º 01’ 12” N - 28º 00’ 24” E), where BOTAŞ natural gas terminal operational zone in Marmara Ereğli of Tekirdağ Province, Trakya Un-Mar natural gas cycle plants and sea floor pipelines and buoys of Bütangaz A.Ş. are located,

harvesting of fisheries are prohibited.

k) In Marmara Sea (in İstanbul), anchor dropping is prohibited within 200 m to the right and left side of the oil – natural gas pipeline in Pendik – Ambarlı.

(5) Followings are the area prohibitions in Black Sea:

1) Within 1 km off the coastal line between the shelter and Kestel Stream in Sürmene District of Trabzon Province,

2) Harvesting of fisheries is prohibited during the season in the area 2000 m. in length and 2500 m. in width, between Petrol Ofisi Oil Filling Plant and Aygaz Filling Plant in Samsun (41º 16’ 00” N - 36º 23’ 00” E), (41º 17’ 00” N - 36º 24’ 00” E), (41º 15’ 00” N - 36º 27’ 00” E), (41º 14’ 00” N - 36º 26’ 00” E),

harvesting of fisheries is prohibited.

SECTION SIX
Other Prohibitions

Other Prohibitions

ARTICLE-21

(1) Other prohibitions on the harvesting of fisheries in the seas are given below:

a) It is obligatory to have such equipment as surface radar and locating instruments like GPS in trawl boats.

b) Use of sonars with a frequency output of 20 Khz (included) and lower is prohibited in harvesting of fisheries in Marmara Sea.

Boats to pass through the Bosphorus and Dardanelles Straits to Marmara Sea, with sonars of 20 Khz (included) and lower, shall have their sonars sealed by provincial administrations and apply to the administrations to unseal them for exit.

c) All and any harvesting of fisheries but those authorized by the Ministry are prohibited in the areas of 500 m. radius facing the sea or direction of river with the river mouths at the center.

ç) Harvesting of fisheries is prohibited in the shelters and slips in ports.

d) Harvesting of fisheries through diving inside surrounding nets, by means of fish spear is prohibited.

e) Underwater guns as well as manually drawing the surrounding nets which have enclosed some area and diving into those nets and hauling them on the coast to gather them in a narrower field (with the method called “hand-pick”) is prohibited.

f) The species, variety, weight, size, catchable amounts and times of the fisheries to be harvested in the exclusive economic zone and the international waters, as well as the fundamental quality and conditions of the respective gears, procedures and principles of their use, and other activities shall be determined by the Ministry. Harvesting outside of National Exclusive Economic Area in the Black Sea is prohibited.

The regulation for the territorial waters specified herein shall also be implemented in the neighbouring exclusive economic area and the international waters, in case of no other relevant regulation is specified and announced by the Ministry.

g) Boats to sail through the prohibited zones at prohibited times for fishing in international waters shall comply with the principles adopted by the Ministry, except for the measures specified in the laws.

Permission of the Ministry shall be required for the Turkish fishing boats to go for fishing activities in the territorial waters of other countries within the framework of the agreements, and the catches shall be landed on the specified ports as per the principles adopted.

ğ). Fishhooks smaller (in size) than no: 10 are prohibited in harvesting of fisheries with set longlines, except for tuna and swordfish catch. When longlining for tuna and swordfish, only hooks no: 1 and 2 are permitted.

ğ). Fishhooks smaller (in size) than no: 14 are prohibited in harvesting of fisheries with set longlines, except for tuna and swordfish catch. When longlining for tuna and swordfish, only hooks no: 1 and 2 are permitted. (Changed Official Journal  23.05.2007-26350)

h) Set gillnets and set longlines let into the sea except than bottom net shall be marked with buoy in the day light, and enlightened buoys at night.

I) 5% of the size of the accidentally (unintentionally) caught fisheries, except for those protected under the Article 6, are permitted.

i) Except for the shrimp trawlers, fishing boats less than 12 m. shall not receive a trawling certificate.

j) I (a) group mine extraction is prohibited in Marmara Sea so as to protect fisheries and their natural environment.

k) Using drift-nets are prohibited in harvesting of fisheries.

l) Letting and setting artificial reefs in the seas and inland waters, i.e. the artificial shelters to hydrophilic living things, which are designed and located in the sea bottom to improve and increase the production of resources so as to protect vulnerable ecosystems and improve fishing, is subject to the permission of the Ministry.

m) Owners/shipowners of the fishing boats to perform harvesting of fisheries in line with the provisions to be adopted by the Ministry shall register their fishing method and the species they catch as per the Article 28 of the Fisheries Law.

n) In case of the capture of labeled (signed) offspring turbot, which are released to the sea to increase turbot stocks in the Black Sea, the nearest provincial or district administrations, or the Directorate of Central Research Institute of Fisheries in Trabzon shall be applied.

PART THREE
Prohibitions in Inland Waters
SECTION ONE
Time and Size Prohibitions

Time and Size Prohibitions

ARTICLE-22

(1) Time Prohibitions for Cyprinidae;

a) In 15th March – 15th June in all waters within the boundaries of the provinces Adana, Adıyaman, Antalya, Aydın, Batman, Denizli, Diyarbakır, Gaziantep, Hatay, İzmir, Kahramanmaraş, Kilis, Manisa, Mardin, Mersin, Muğla, Osmaniye, Siirt, Şanlıurfa and Şırnak,

b) In 1st April – 30th June in all waters within the provinces of Afyon, Aksaray, Amasya, Ankara, Balıkesir, Bartın, Bilecik, Bolu, Burdur, Bursa, Çanakkale, Çankırı, Çorum, Düzce, Edirne, Eskişehir, Isparta, İstanbul, Karabük, Karaman, Kastamonu, Kırıkkale, Kırklareli, Kırşehir, Kocaeli, Konya, Kütahya, Nevşehir, Niğde, Sakarya, Samsun, Sinop, (Changed Official Journal  23.05.2007-26350)Tekirdağ, Uşak, Yalova and Zonguldak,

c)In 15th April – 15th July in all waters within the boundaries of the provinces Artvin, Bingöl, Elazığ, Erzincan, Giresun, Gümüşhane, Kayseri, Malatya, Ordu, Samsun, Sinop, (Changed Official Journal  23.05.2007-26350) Rize, Sivas, Tokat, Trabzon, Tunceli and Yozgat.

ç) In 15th May – 15th August in all waters within the boundaries of the provinces Ağrı, Ardahan, Bayburt, Bitlis, Erzurum, Hakkari, Iğdır, Kars, Muş and Van, Cyprinidae harvesting is prohibited. (See Map - 43)

d) In case of the provinces falling under the two or more of the regional classifications under this article, the prohibition of the larger fishing zone shall apply.

e) Cyprinidae prohibition shall also apply to the species (except for sand smelt) exposed to no prohibition herein.

(2) Length and Weight prohibitions;

SECTION TWO
Genus and Species Prohibitions

Trout Catch

ARTICLE-23

(1) Trout catch is prohibited during the season in the areas given in following. ;

a) In the rivers and their arms in Ardahan, Bayburt, Erzurum, Kars, Tunceli and Van provinces and the rivers Aras and Çoruh and their arms,

b) In the part of Eşen Stream between Kırkpınarlar and Ören in Fethiye District of Muğla Province, and in Yuvarlak Stream of Köyceğiz District.

c) In Ünlendi and Hamurkesen Stream within 20 km areas between Karacaören village and Üçkayalar village in Tucluca District of Iğdır province,

ç) In Munzur and Pülümür Streams of Tunceli Province,

d) In İvriz and Delimahmut Streams in Konya Province,

All and any harvesting of trout is prohibited. 

(2) Catching of all trout species is prohibited in 1st September – 31st March in all inland waters other than those specified.

On the other hand, rainbow trout catch is permitted during the season in the dam lakes Burdur- Yapraklı and Karacaören II, Çankırı – Güldürcek, Bolu – Gülköy, Samsun – Derbent, Kastamonu – Beyler, Konya-İvriz and Gezende, Erzurum – Kuzgun and Van – Zernek.

(3) Trout catch with fishing rod is permitted out of the prohibited time in the rivers and ponds smaller than 1 km². Trout catches with other gears are prohibited in those regions.

Steindaehner and Eel Catch

ARTICLE-24

(1) Steindaehner catch is prohibited in all inland waters in 1st April – 30th June.

(2) Eel catch is prohibited in 1st April – 30th June in Gölbaşı Lake and River Asi, in Hatay Province.

Crayfish Harvesting

ARTICLE-25

(1) Catching, shipping, marketing, exporting and processing of crayfish are prohibited in all inland waters in 1st November – 30th June. However, new prohibitions may be introduced or the period may be extended by the Ministry following the diseases.

(2) Crayfish landing in in-forest waters bound to the Ministry of Environment and Forestry is prohibited during the term.

(3) Landing with any kind of bait is prohibited.

(4) Being selective in harvesting the same gender -as male and female- of crayfish is prohibited.

(5) Crayfish smaller than 9 cm. are returned to water upon being taken out of the basket. Stocking non-elected crayfish in fishponds, pools, stores and processing facilities is prohibited. All crayfish in good condition are returned to water, without any classification, if crayfish smaller than 9 cm. are detected in any place up to 10% or more. Diseased and dead ones are destroyed.

(6) It is obligatory that the stocks of alive crayfish including those caught before the fishing prohibition be detected by the provincial administrations of the Ministry within 48 hours following the prohibition start. It is obligatory that these crayfish be processed and marketed within 7 days at the most following the prohibition start.

(7) Landing points of lakes where crayfish are harvested shall be determined and announced by the provincial administrations. Landing at other points than determined is prohibited.

(8) A “Certificate of Origin” included in Annex-3 for the harvested crayfish shall be required from provincial or district administrations. Crayfish shall not be shipped and marketed without the said certificate.

(9) No Certificate of Origin shall be drawn up for the crayfish harvested in the not-rented zones or those with renting procedures incomplete.

(10) Illegally caught living crayfish shall be returned to the water in which they were caught. If the former is impossible, process as per Article 34 of Fisheries Law shall be implemented.

(11) Transferring all sorts of gears between waters without permission and using them without disinfecting are prohibited.

Needlefish Catch

ARTICLE-26

(1) Needlefish catch is prohibited in all inland waters in 15th December – 31st March.

(2) Needlefish catch is prohibited in Işıklı and Karamık Lakes within the prohibition period of carp catch.

Pike Perch and Perch Catch

ARTICLE-27

(1) Catching of pikeperch and perch with any gears is prohibited in all inland waters in 15th March – 30th April.

(2) Pike perch and perch can only be caught with set longline during the times when catching of Cyprinidae is prohibited.

(3) Catching of pike perch and perch with any gears is prohibited during the time when Cyprinidae catch is prohibited in Beyşehir, Eğirdir-Hoyran, Uylupınar (Gölhisar), Gölmarmara lakes and Hirfanlı, Avşar and Sevişler dam lakes.

(4) In Beyşehir Lake, pikeperch catch with set longline is prohibited during the season.

(5) Living fish use as bait is prohibited in longlining for pikeperch.

(6) Landing of the harvested pike perches from other points than those determined by the provincial administrations is prohibited.

(7) A “Certificate of Origin” included in annex-3 shall be required from provincial or district administrations for pikeperch.

(8) Processing and exporting of pike perches without a Certificate of Origin are prohibited.

Carp, Tench, Catfish, Chalcalburnus tarichi and Sandsmelt Catch

ARTICLE-28

(1) Catfish catch is prohibited during the term in Ulubat Lake and its arms.

(2) Catfish catch is prohibited at times when Cyprinidae catch is prohibited in inland waters where catfish live.

(3) Chalcalburnus tarichi (mullet) catch with any sort of gear is prohibited in 15th April – 30th June in Van Lake basin and all inland waters where Chalcalburnus tarichi live.

(4) Sandsmelt catch is allowed within the areas specified by the provincial administrations on condition of taking permission from the Ministry with beach seines (Iğrıp and manyat) during the season. A “Certificate of Origin” included in Annex-3 for the harvested products shall be required from provincial or district administrations.

Frog, Snail and Leech Harvesting

ARTICLE-29

(1) Catching and collecting of frogs are prohibited in 1st May – 30th June is prohibited.

(2) Catching and collecting of Rana holtzi species frogs are prohibited during the season in Niğde Bolkar Mountains and around Karagöl and Çiniligöl

(3) Catching and collecting of snail in 1st June – 31st July is prohibited.

(4) Catching and collecting of leech in 1st March-30th June is prohibited.

(5) It is obligatory that the living frogs, snails and leeches, whose stocks have been detected by the provincial or district administrations as of the beginning of the prohibited period, are processed or shipped within 10 days at the most from the prohibition start.

Water Plants (Cane, Reed, etc) Clipping

ARTICLE-30

(1) Clipping water plants is prohibited in 1st March – 31st July in all inland waters, and;

a) in 1st April – 31st July in Eğirdir-Hoyran, Hotamış and Beyşehir Lakes,

b) in 1st April – 31st October in Karamık, Eber and Akşehir Lakes,

c) in 1st April – 15th August in the inland waters in Van Province,

d) in 1st January – 30th September in Akgöl, Fiyat, Sazlı Lakes and Cırba Stream in Göksu delta.

(2) Water plants clipping shall be performed in line with the provisions to be determined by the provincial administrations, at times outside the prohibited period.

(3) Burning water plants in inland waters and clipping or burning in-forest water plants bound to the Ministry of Environment and Forestry are prohibited.

SECTION FOUR
Other Regulations on Fishing in Inland Waters

Fishing in Ponds and Running Waters

ARTICLE-32

(1) Commercial harvesting of fisheries within the ponds and running waters other than allowed by the Ministry or whose project received approval from the Ministry for the commercial harvesting of fisheries is prohibited. Laws and procedures on harvesting in ponds and running waters where open to harvesting as per permission or under the project will be drawn up by the Ministry.

Time prohibitions and species regulations for the related province as specified in the Article-22 shall be taken as basis in commercial harvesting of fisheries in running waters.

(2) Commercial harvesting of fisheries is prohibited in in-forest running waters. The provisions and procedures of the “Circular on Sports Fishing” shall govern sports fishing.

Measures to be Taken in Inland Waters

ARTICLE-33

(1) Insertion of all and any sort of net, reservoirs, fence and similar barriers in the openings and end of all the canals used for irrigation or other purposes in fisheries harvesting zones in a way to prevent migration, transition and development of the fisheries in natural lakes, dam lakes, ponds, storage, running waters, etc other than those which are allowed by the Ministry to prevent fish loss is prohibited..

(2) Within all the inland waters, it is obligatory that vessels be landed during the periods where fishing is prohibited.

Prohibitions on Nets

ARTICLE-34

(1) Fishing with nets other than those whose minimum quality and conditions are to be determined and announced by the provincial administrations is prohibited in inland waters.

(2) Other than sandsmelt, catching with ığrıp or manyat is prohibited with in inland waters.

(2) Fishery by beach seine nets (specifically ığrıp and manyat) without permission of the Ministry is prohibited in all inland waters. (Changed Official Journal  23.05.2007-26350)

(3) Purse seines and all sorts of trawl nets are prohibited in inland waters.

(4) Mesh size of the nets to be used in Van Lake and its downstreams in the provinces of Van and Bitlis shall be no smaller than 40 mm.

PART FOUR
General Provisions on Seas and Inland Waters

Measures to be Taken in Seas and Inland Waters

ARTICLE-35

(1) Measures to be taken in catching and harvesting of fisheries in seas and inland waters are given below:

a) It is obligatory that stock assessment shall be made for products caught and to be offered for sale and the products in processing, handling and storage facilities before commencement of the prohibition, by applying to provincial administration in the area where products or facility is located within 24 hours following the prohibition start, as any commercial operation, shipment, and use in production of the fisheries are also prohibited during the fishing prohibition.

Fisheries of which stock assessment is made shall not be used, sold, shipped or exported without the permission of the provincial administration.

b) An export permit shall be required from the provincial administration carrying out stock detection, for the export of the fisheries during the prohibition time which were stocked before the prohibition.

c) A “Certificate of Origin” included in the annex-3 shall be required from the related provincial or district administration of the area where catch was performed, for the shipment of the fisheries caught at permitted times and places to the prohibited areas, and the Certificate should be presented to the authorities, when asked.

ç) Permission is required from the related provincial administration to sell the fisheries which are shipped to prohibited areas with the Certificate of Origin.

Provincial administrations may hand over such power to the district administrations under compelling situations.

d) The Certificate of Origin to be drawn up shall comply with the prohibitions, limitations and liabilities in terms of time, place and gears specified herein.

e) Inland fish caught before the prohibition shall be sold, shipped, marketed and processed within 7 days at the latest following the date when prohibition starts.

2. All sorts of fishing equipment, gears, tools, baits and sets are prohibited in ships and harvesting areas during prohibited term. This prohibition does not apply to the ships which have the permission from the provincial administrations for sailing through the prohibited areas during the term.

3. Commercial harvesting of fisheries through underwater diving with tubes, air supplies, masks and fishing spears, using schnorchel and underwater gun is prohibited.

4. Any fishing activity using any explosives, anesthetic, noxious, narcotic, stimulant and poisonous chemical substances, carbide, abrasives and burnt lime, fish poison (cocculus indicus), and keeping the same onboard the vessel and its vicinity are prohibited.

5. Permission from the Ministry is required for those to carry out scientific and technical research or studies or to harvest through the procedures or equipment of bottom trawling, power or electroshock.

6. For protective purposes, permission is required from the Ministry for all scientific and technical research and studies on fisheries in the harvesting areas under the rule or protection of the State or under the possession of Treasury or Directorate General for State Hydraulic Affairs, and for all production and improvement activities.

7. For keeping aquaculture under control nationwide, permission is required from the Ministry for realizing commercial procedures on the fisheries, breeding herds and their eggs, larva, offspring and adults, and water plants, their shipment, and their catch and collection in harvesting areas and use in all facilities and releasing them to water, on condition that the provisions of Paragraph 10 remains reserved.

8. Permission is required, in advance, from the Ministry for all plants and enterprises to be built for fisheries production in the land and sea and in inland waters.

a) All and any harvesting of fisheries are prohibited within 200 m. around the cages belonging to aquaculture plants.

b) Shipment and sales of the fisheries procured for aquaculture are not bound to length, time and place prohibitions on condition of having a Certificate of Origin.

c) All and any harvesting of fisheries is prohibited within a distance of 500 m. radius of the water intake ports of the water station system of all hatcheries where fisheries are procured.

9. Permission is required from the provincial administrations for building commercial ponds, pools and fishponds for stocking living fisheries, save for the offspring.

10. Commercial harvesting of fisheries is prohibited in harvesting zones whose renting procedures are incomplete or for which bidding is not yet been performed, until the time when renting procedure is complete.

a) Any fishing activity within all the sea and inland waters area permitted by the Ministry on the project basis for the commercial fishing by any parties other than holder is prohibited during the renting period.

b) Juvenile stocking by entrepreneurs for aquaculture purposes with a “Certificate for Living Stocks” to be obtained from the provincial administrations of the harvesting zones whose renting procedures are incomplete are prohibited even if the projects are approved.

11 Collecting of juvenile fish is prohibited in coastal lines such as coastal lagoons, lagoons, downstream of rivers, where sea fish seek shelter for food and breeding.

12. License number of the license drawn up for the ship shall be visibly written on the ship as plate.

13. The Ministry shall be entitled to identify and announce the prohibitions, limitations and responsibilities specified in this circular. Civilian administrations, other ministries and the related public institutions, real and legal persons shall not annul the prohibitions defined, shall not adopt and announce new decisions on prohibitions or decisions contrary to these prohibitions on no condition except for natural disasters (drought, flood, fire, health, etc.).
