REGULATION ON THE IDENTIFICATION, REGISTRATION AND MONITORING OF BOVINE ANIMALS Print

PURPOSE, SCOPE, LEGAL BASIS AND DEFINITIONS

Purpose

Article 1- The purpose of this Regulation is to provide a more effective control of animal movements and animal diseases; to support the efficient functioning of the eradication programs both at national and regional level, and to determine the principles and procedures on the identification and registration of animal holdings and bovine animals kept in these holdings, and on the monitoring of animal movements with the aim of keeping, updating and evaluating regularly the necessary health, breeding, statistics and support payment records.

Scope

Article 2- Identification of bovine animals of all age groups; type and nature of the equipment and the method to be used for identification; technical properties of the coding system; registration of the identified animals and of the holdings the animals are kept in; identification of the keepers; establishment and operation of the computerized database; issuing of passports for the identified bovine animals; exchange of the information and data on the identified animals and the holdings these animals are kept in; monitoring and control of the animal movements within the system; recording of information on health conditions of the herds and information on support payments; checks on and supervision of identified animals and holdings, and all other operations related to the issues mentioned above are within the scope of this Regulation.

Legal basis

Article 3- This Regulation is prepared on the basis of Law No. 3285 on Animal Health and Surveillance dated 8 May 1986 and Law No. 4631 on Animal Breeding dated 28 February 2001.

Definitions

Article 4- For the purposes of this Regulation,

a) Ministry shall mean the Ministry of Agriculture and Rural Affairs;

b) Central Competent Authority shall mean the Domestic Animal Movement Unit of the Directorate General of the Ministry in charge of veterinary services and of the implementation of this Regulation;

c) Rural Unit shall mean the Provincial and District Directorates;

d) Official Veterinarian shall mean Government Veterinary Officers defined under Article 3 of Law No. 3285 on Animal Health and Surveillance;

e) Keeper shall mean any natural or legal person who is responsible for and legal owner of the holdings and animals within these holdings within the scope of this Regulation or his/her legal representative undertaking the responsibility, transportation and management of these animals temporarily or permanently;

f) Holding shall mean any establishment, construction or, in case of an open-air farm, any place in which animals covered by this Regulation are held, kept, handled or fed;

g) Bovine animal shall mean cattle and buffaloes including Bison bison and Bubalus bubalus species, of all ages, kept for meat production, dairy production, breeding or other purposes;

h) Buyer shall mean any natural or legal person such as keeper, fattener, animal trader, butcher or the operator of slaughterhouse or meat plant, or their legal representatives who buy live animals;

i) Seller shall mean any natural or legal person such as keeper, fattener, animal trader, butcher or the operator of slaughterhouse or meat plant, or their legal representatives who sell live animals;

j) Herd shall mean all bovine animals with the same health status kept on a holding or different bovine animal groups with different health status kept on the same holding;

k) Passport shall mean the document prepared by the rural unit containing the information laid down in Article 54 of this Regulation, specimen of which is given in Annex 8 of the Regulation;

l) Inspector shall mean Official Veterinarians or other official supervisors who are appointed by the Central Competent Authority or Rural Unit in order to carry out the checks defined under Chapter 8 of this Regulation;

m) Slaughterhouse or meat plant shall mean slaughterhouses or meat plants licensed in accordance with the provisions of the Regulation on the Procedure and Principles for the Establishment, Commencement, Operation and Inspection of Red Meat and Meat Product Establishments published in the Official Gazette No. 24167 of 11 September 2000;

n) Slaughterhouse or meat plant operator shall mean any natural or legal person who is the legal owner of the slaughterhouse or meat plant or his/her legal representative undertaking temporarily or permanently the responsibility, transportation and management of such establishments;

o) Animal Markets shall mean animal parks, markets and stock markets where animals from different holdings are gathered for trade purposes and which are licensed in accordance with the provisions of Communiqué No. 2000/34 on the Procedure and Principles for Licensing and Supervision of Animal Markets published in the Official Gazette No. 24171 of 15 September 2000.

p) Animal market operator shall mean any natural or legal person who is the legal owner of the animal market or his/her legal representative undertaking temporarily or permanently the responsibility, transportation and management of such markets.

SECTION II

DUTIES, POWERS, RESPONSIBILITIES AND LIABILITIES

Power and responsibility

Article 5- The Ministry shall be authorized and responsible for the identification of the bovine animals within the scope of this Regulation, registration of these animals in the holdings, issuing of passports for the registered bovine animals, registration of the holdings and carrying out of other related operations.

Duties and responsibilities of the Central Competent Authority

Article 6- Central Competent Authority shall be authorized, assigned and responsible for the establishment of the computerized database on animal movements and animal health; for ensuring the flow of information between rural units; for the inspection and supervision of the activities of the rural units, and for the operation, development and implementation of the central database.

Duties and responsibilities of the rural unit

Article 7- Rural unit, within the field of its power, duty and responsibility, shall be authorized, assigned and responsible for approving the compliance with the conditions laid down in Article 50 and 51 of the eartags to be used for the identification of the bovine animals; for allocating to the holdings eartag numbers that are to be used to identify the animals individually; for allocating holding numbers to the holdings within the province; for registering the identified and recorded animals, and the holdings which they are kept in; for transferring the information laid down in Article 46 to the computerized database; for issuing the passports of the bovine animals to be given to the keepers; for ensuring that the keepers maintain up-to-date records of the bovine animals on their holdings; for carrying out the inspection and supervision of the identified and registered animals and holdings; for preparing reports on the inspections; for imposing sanctions on keepers infringing the provisions of this Regulation, and for implementing the other relevant provisions of this Regulation.

Responsibilities and liabilities of the keepers

Article 8- Keepers shall be responsible and liable for having their holdings registered, for having the bovine animals on their holdings identified and registered through passports; for keeping records with regard to the birth, death and slaughtering for emergency reasons of the bovine animals on their holdings and with regard to the animal movements from or to their holdings and for notifying these information to the rural units; for assisting the inspectors during their inspection of the holdings and examination of the records of the holdings; for meeting the expenses of identification and registration of the bovine animals on their holdings and for carrying out other provisions of this Regulation related to keepers.

Responsibilities and liabilities of the buyers and sellers

Article 9- Buyers and sellers shall be responsible and liable for notifying the necessary information on the bovine animals traded to the rural units.

Responsibilities and liabilities of the operators of slaughterhouses and meat plants

Article 10- Operators of slaughterhouses shall be responsible and liable for checking whether the bovine animals brought to their slaughterhouses or meat plants for slaughtering purposes are identified in accordance with the provisions of this Regulation and whether passports accompany these animals; for not permitting the slaughtering of bovine animals that are not identified in accordance with the provisions of this Regulation or those that are not accompanied by passports or those that are accompanied by incorrect passports; for reporting to the rural units the people bringing such animals to their holdings; for surrendering the passports, together with the slaughter date, of the bovine animals slaughtered to the rural unit at the place where the slaughterhouses and meat plants are located; for collecting the eartags of the bovine animals slaughtered and for destroying these eartags under the control of the rural unit at the place where the slaughterhouses and meat plants are located, in accordance with the procedures and principles determined by the Ministry, and for carrying out other provisions of this Regulation related to them.

Responsibilities and liabilities of the operators of animal markets

Article 11- Operators of animal markets shall be responsible and liable for checking whether the bovine animals brought to their establishments for sale are identified in accordance with the provisions of this Regulation and whether passports accompany these animals; for not permitting the entrance to their establishments of bovine animals that are not identified in accordance with the provisions of this Regulation or those that are not accompanied by passports or those that are accompanied by incorrect passports; for receiving the passports from the keepers of animals let into the market; for returning the passports to the keepers of animals not sold; for returning the related parts of the passports to the buyer and seller of bovine animals traded, and for carrying out other provisions of this Regulation related to them.

SECTION III

IDENTIFICATION AND REGISTRATION SYSTEM OF BOVINE ANIMALS

Elements of the system

Article 12- The system for the identification and registration of bovine animals shall comprise the following elements:

a. eartags identifying the animals individually,

b. computerized database,

c. animal passports,

d. individual registers kept on each holding.

Access to information

Article 13- Central Competent Authority shall have access to all information under this Regulation, while the rural unit shall have access to all information concerning its duty, authorization and responsibility. The Ministry shall take the measures necessary to ensure access to this data for all parties concerned, including consumer organizations, which are recognized by the Ministry, provided that the data confidentiality and protection prescribed by the national legislation are ensured.

Identification of bovine animals

Article 14- With the exception of animals identified before the date of entry into force of this Regulation, all bovine animals shall be identified upon application of their keepers by submitting the form laid down in Annex 5 of this Regulation and through the application of an eartag approved by the rural unit at provincial level to each ear in accordance with the relevant provisions of this Regulation. Both eartags shall bear the same unique identification code, which makes it possible to identify each animal individually. For each identified bovine animal, the form laid down in Annex 6 of this Regulation shall be filled out.

Article 15- Eartags, printed with the individual identification numbers of the bovine animals, shall be allocated and distributed by the relevant rural unit at provincial level to the holdings within the field of its authorization and responsibility, and shall be applied to the bovine animals in accordance with the procedures and principles determined by the Ministry.

Individual identification numbers on eartags of identified bovine animals shall by all means specified in animal insurance documents; documents accompanying the samples taken with regard to animal health and animal husbandry; documents on laboratory analyses and analysis reports; origin certificates; all sorts of veterinary health reports including those issued for internal animal movements; proforma invoices or invoices with regard to trade in animals; all sorts of animal certificates; all sorts of documents on the products of bovine animal origin, and all sorts of other documents to be issued regarding bovine animals and animal husbandry.

Article 16- The eartag shall be applied within a period not later than 20 days as from the birth of the bovine animal and in any case before the animal leaves the holding on which it was born. No bovine animal born after the entry into force of this Regulation may be moved from the holding in which it is kept, unless it is identified in accordance with the conditions set by this Regulation.

Article 17- Bovine animals imported from a country other than the Member States of the European Union which have passed the checks laid down in the national legislation shall be identified on the holding of destination by eartags complying with the requirements of this Regulation, within 20 days following the aforesaid checks, and in any event before leaving the holding.

It is not necessary to identify the animals if the holding of destination is a slaughterhouse or meat plant and the animal is slaughtered within 20 days of undergoing the checks stated in the first paragraph of this Article.

In case of imports of bovine animals from countries other than the Member States of the European Union, if the bovine animals are identified by the exporter country, original identification established by the exporter country shall be recorded in the computerized database provided for in Article 46 together with the identification code allocated to it by the holding of destination.

Article 18- Bovine animals imported from the Member States of the European Union shall retain their original eartags and shall be recorded in the computerized database through their original individual identification numbers.

Article 19- No eartag may be removed or replaced without the permission of the Central Competent Authority or the relevant rural unit.

Article 20- No bovine animal may be recorded in any computerized database related to animal husbandry unless it is identified in accordance with the conditions set by this Regulation.

Article 21- If the keeper finds out that one or both of the eartags of any identified bovine animal have been lost or the data on the eartags have become illegible, the keeper shall apply to the rural unit within 28 days and new eartag(s) with same unique identification codes shall be replaced with the lost or illegible eartag(s).

In application of the first paragraph of this Article to bovine animals imported from the Member States of the European Union, lost or illegible eartag(s) shall be replaced by new eartag(s) carrying the original individual identification number given by the exporter country and the logo of the Ministry.

Computerized database

Article 22- Central Competent Authority shall set up a fully functional computerized database in accordance with the provisions of Articles 45 and 46. All data required by this Regulation shall be stored in this computerized database.

Passports of bovine animals

Article 23- For each animal that is identified in accordance with Article 14, the relevant rural unit shall issue a passport within 14 days of the notification of its birth through the form laid down in Annex 9 of this Regulation; in the case of animals imported from third countries other than the Member States of the European Union that are re-identified in accordance with Article 17, the relevant rural unit shall issue a passport within 14 days of the re-identification.

Passports accompanying bovine animals imported from the Member States of the European Union shall be surrendered to the relevant rural unit and new passports shall be issued for these animals under the conditions laid down in the first paragraph of this Article.

Article 24- Whenever a bovine animal is moved, it shall be accompanied by its passport. In case bovine animals are moved from or to holdings by means of trade in animals, both buyers and sellers shall notify the relevant rural unit within seven days together with the relevant parts of the passports.

Article 25- In the case of the death of a bovine animal, the passport shall be returned by the keeper to the relevant rural unit within seven days after the death of the animal, together with the form laid down in Annex 10 of this Regulation filled out by the keeper.

In case the bovine animal is sent to the slaughterhouse or meat plant, the operator of the slaughterhouse or meat plant shall be responsible for returning the passport to the rural unit at the place where the holding is located.

Article 26- With regard to the trading of bovine animals slaughtered for the purpose of the Feast of Sacrifice, with the aim of deleting the records of the slaughtered animals, the seller shall surrender the relevant portion of the passports within seven days to the closest rural unit stating the purpose of the trade and the buyer shall surrender the passports of the bovine animals to the closest rural unit within seven days of the slaughter, stating the dates of the slaughter.

Article 27- If the carcasses of the bovine animals that are slaughtered for emergency reasons in the holdings cannot be sent to the slaughterhouse or meat plants, their passports shall be surrendered to the relevant rural unit within seven days after the slaughter of the animals together with the form laid down in Annex 10 of this Regulation filled out by the keeper.

If the carcasses of the bovine animals slaughtered for emergency reasons on the holdings are sent to the slaughterhouse or meat plants, the keeper shall fill out only the form laid down in Annex 10 of this Regulation, stating the date and reason of slaughter and delivery date to the slaughterhouse and surrender the form to the relevant rural unit, while the passports of the slaughtered animals shall be surrendered to the slaughterhouse or meat plants together with their carcasses and the operators of the slaughterhouse or meat plants shall be responsible and liable for returning these passports to the relevant rural unit at the place where the holding is located.

Article 28- In the case of bovine animals exported to countries other than the Member States of the European Union, passports of the animals shall be surrendered by the keeper to the relevant Quarantine Station and Customs Veterinary Directorate or rural unit responsible for the export health checks, to be transmitted to the rural unit at the place where the holding the animals are recently registered resides. Surrendered passports shall be sent by the relevant Quarantine Station and Customs Veterinary Directorate or rural unit to the rural unit at the place where the holding the animals are recently registered resides and their registration shall be deleted.

In the case of animals transferred to the Member States of the European Union, one copy of the passports of the animals transferred shall be surrendered to the relevant Quarantine Station and Customs Veterinary Directorate or rural unit that issue the International Animal Health Certificate. These copies of the passports shall be sent to the rural unit at the place where the holding the animals are recently registered resides, stating the country name and date of exportation. The registration of these animals kept in the holdings shall be deleted.

Article 29- In case the passport of the bovine animal has been lost, stolen or destroyed, the keeper shall report the situation to the relevant rural unit in writing within fourteen days. Upon the request of the keeper, if appropriate, the rural unit may reissue a passport for these bovine animals.

In case the keeper finds the original passports after new passports are issued, he shall report the situation to the relevant rural unit and surrender the original passports unit within seven days.

Article 30- In case a bovine animal with a passport has been lost or stolen, keeper shall report the situation to the relevant rural unit and surrender the passport of that animal within seven days. If the lost or stolen animal is found later on and if this animal matches with the description and individual identification number specified on the passport, passport belonging to this animal shall be returned back to the keeper by the relevant rural unit.

Keeping registers

Article 31- With the exception of transporters, each keeper shall keep an up-to-date register; record to the holding registration form all movements to and from the holding and all births and deaths of animals on the holding, along with the dates of these events, and report to the relevant rural unit these records within seven days of the event occurring.

Article 32- Each keeper shall check the passport of the each bovine animal on its arrival to the holding and shall ensure that the passport accompanies it prior to departure of the bovine animal from the holding.

Article 33- Each keeper shall supply the Central Competent Authority or relevant rural unit, upon request, with all information concerning the origin, identification and, where appropriate, destination of bovine animals which he has owned, kept, transported, sold, bought or slaughtered, and information on the bovine animals born, died or slaughtered on his/her holding(s).

Article 34- The register shall be in a format laid down in Annex 11 of this Regulation, kept in manual or computerized form, and be available at all times to the Central Competent Authority or relevant rural unit upon request, for a minimum period of three years.

Inspection and controls

Article 35- Controls on the holdings, on the identification and registration of bovine animals and on the slaughterhouses and meat plants within in the context of this Regulation shall be carried out by the Central Competent Authority or by the relevant rural units.

Administrative sanctions

Article 36- Administrative sanctions shall be imposed in case of infringement of the provisions of this Regulation and no incentive, support or premium payments shall be given to any holding and bovine animal unless they are identified and registered in accordance with the provisions of this Regulation.

Costs

Article 37- Keepers shall be charged for the costs of the systems referred to in Article 12 of this Regulation and for the costs of the controls referred to in this Regulation.

SECTION IV

IDENTIFICATION AND REGISTRATION OF HOLDINGS

Application and registration

Article 38- All holdings with bovine animals shall be identified and registered.

Article 39- For identification and registration purposes of the holdings, the keepers shall fill out the form laid down in Annex 2 of this Regulation and apply to the rural unit at the place where the holding resides.

Identification of holdings

Article 40- Holdings shall be identified through a province identification code of holding allocated by the relevant rural unit in accordance with Article 42 of this Regulation. Identification code of holding shall not be repeated.

Identification code of holdings

Article 41- A unique holding code shall be allocated for each holding upon the application of the keeper as provided for in Article 39. In case a keeper owns more than one holding, a separate unique identification code of holding shall be allocated for each holding.

Article 42- Identification code of holdings shall be allocated and registered as follows;

a. identification code of holdings shall compose of a number of maximum of 10 digits following the two-letter country code as provided for in Article 48 and two-digit provincial traffic code,

b. identification code of holdings shall be recorded in the computerized data base, passports of animals on the holdings and holding registration documents specified in Article 43,

c. identification code of holdings shall not be printed on the eartags.

Registration of holdings

Article 43- Holding registration document laid down in Annex 3 of this Regulation shall be issued for the keeper whose application is approved and evaluated by the rural unit where the holding resides and consequently whose holding(s) are identified.

Holding registration label

Article 44- Keepers for which holding registration documents are issued may print a holding registration label with self-adherence property in accordance with the information on the holding registration document and the specimen laid down in Annex 4 of this Regulation. Holding registration label printed by the keeper in accordance with the specimen shall be adhered to that section of the passport containing information on the buyer of the animal during the purchase of the bovine animals. If the buyer does not have a holding registration label, the required information may be written manually or stamped by a cachet to that section of the passport containing information on the buyer of the animal.

SECTION V

COMPUTERIZED DATABASE

Compatibility with other databases

Article 45- The database referred to in Article 22 shall be compatible with other relevant national databases and shall also be appropriate for exchange of information with these databases.

Data to be stored in the database

Article 46- The computerized data base shall contain at least the following information:

a. For each identified and registered bovine animal:

- individual identification number,

- date of birth,

- sex of the animal,

- breed of the animal,

- individual identification number of its mother or in the case of animals imported from countries other than the Member States of the European Union, the individual identification number in connection with the origin identification number, given pursuant to paragraph 3 of Article 17,

- identification number of holding of birth,

- identification number of holdings the animals are held and date of transfers from holdings,

- date and place of death or of emergency slaughtering on the holding,

- in case of slaughter at the slaughterhouses or meat plants, name, address and license number of the slaughterhouse or meat plant as well as the date of slaughter.

b. For each holding:

- identification number of maximum of 12 digits in addition to the country code,

- name, address and, if available, phone number of the keeper who is the owner of the holding or legally responsible for the holding.

c. The following information shall be reached at any time from the data base:

- individual identification numbers of all bovine animals on the holdings,

- for each animal, the list of holdings the animals were held in, starting from the holding of birth or in case of animals imported from countries other than the Member States of the European Union, the holding the animal was imported from.

d. Whether support or premium payments are given for identified and registered bovine animals and, if so, the date of support or premium payments.

This data shall be available on the database for three years following the death or slaughter of the bovine animal.

SECTION VI

EARTAGS

Items on the eartags

Article 47- Eartags used for the identification of the bovine animals in accordance with the provisions of this Regulation shall carry at least the following items and characters:

a. Eartags shall contain the logo of the Ministry laid down in Annex 1 of this Regulation,

b. The individual identification number on the eartags of the bovine animals shall be of at most 14 characters. The characters on these eartags shall be as follows:

- the first two positions shall identify the two-letter country code,

- the characters following the country code shall identify the two-digit provincial traffic code where the holding the animal is kept in resides,

- the characters following the provincial traffic code shall be numeric with maximum 10 digits and shall identify the provincial individual number of the animal.

Article 48- Within the framework of this Regulation, the country code shall be TR.

Article 49- Eartags shall contain a barcode as well. The specifications of the bar codes will be determined by the Ministry.

Technical characteristics and the requirements of the eartags

Article 50- Eartags used in the identification of bovine animals;

a. shall be well-made, shall be produced from flexible high quality plastic material that doesn’t break when bent, with a color of lemon yellow;

b. shall be physically tamper-proof and resistant to different weather conditions and easy to read throughout the lifetime of the animal;

c. shall not be re-usable;

d. shall be of a design which will remain attached to the ear of the animal without being harmful to its ear tissue and itself;

e. shall carry only non-removable and unchangeable inscriptions as provided for in Article 47 and the bar codes specified in Article 49.

Structure and the model of the eartags

Article 51- The structure and the model of the eartags used in the identification of bovine animals shall be as follows:

a. each eartag shall consist of two parts, a male part and a female part,

b. each part of the eartag shall contain only the information and the elements provided for in Article 47 and Article 49, printed in a way that is non-removable laser technique,

c. the length of the eartag shall be at least 45 mm for each part,

d. the width of the eartag shall be at least 55 mm for each part,

e. the characters on the eartag shall have a minimum height of 5 mm.

Article 52– The Ministry may choose other material or model for the eartag to be applied to the second ear, provided that the provisions of Article 47 are complied with.

In addition to the provisions laid down in Article 50 and Article 51 of this Regulation, additional requirements with regard to the quality, structure and model of the eartags to be used for the identification and registration of bovine animals shall be determined by the Ministry.

SECTION VII

PASSPORTS AND REGISTERS

Passports

Article 53- For each bovine animal identified in the holdings that are registered, a passport shall be issued by the application of the keeper with the form as provided for in Annex 7 of this Regulation.

In case bovine animals with passports issued in accordance with Article 23 of this Regulation are bought, the buyer shall apply for new passports with the form laid down in Annex 7 of this Regulation at the time he/she notifies the relevant rural unit together with the relevant parts of the passports belonging to the animals bought in accordance with Article 24. New passports shall be issued by the relevant rural unit for these animals within 14 days.

Article 54- Passports issued for identified bovine animals shall contain at least the following:

a) the information referred to in paragraphs a), b) and d) of Article 46 of this Regulation,

b) the name, surname, address and signature of the keeper(s), with the exception of the transporter,

c) the name and seal of the issuing rural unit and the signature of the representative of the authority,

d) the date of issue of the passport.

Passports to be issued may contain a barcode as well

Registers

Article 55- Registers that will be kept by the keepers for bovine animals on the holdings registered shall contain at least the following information:

a) Following information for each identified and registered bovine animal:

- individual identification number,

- date of birth,

- sex of the animal,

- breed of the animal,

b) the date of death of the animal on the holding,

c) in the case of animals departing from the holding, the name and address of the keeper, with the exception of the transporter, or the identification number of the holding, to whom/which the animal was transferred, as well as the date of departure,

d) in the case of animals arriving on the holding, the name and address of the keeper, with the exception of the transporter, or the identification number of the holding, from whom/which the animal was transferred, as well as the date of arrival,

e) the name and signature of the representative or inspector of the Central Competent Authority or relevant rural unit who has checked the register, and the date on which the check was carried out

SECTION VIII

INSPECTIONS

On-the-spot inspections

Article 56- With the aim of inspecting the application of the provisions of this Regulation, on-the-spot inspections shall be conducted by rural units. Those inspections shall each year cover at least 5 % of holdings situated in the territory of the rural units. That minimum rate of control shall be increased where it is established through the inspections that the provisions of this Regulation have not been complied with.

Article 57- On-the-spot checks shall in general be unannounced. Where advance warning is essential, it shall not exceed 48 hours.

Selection of holdings to be inspected

Article 58- The selection of holdings to be inspected by the rural unit shall be made on the basis of a risk analysis.

Risk analysis

Article 59- The risk analysis for each holding shall take into account in particular the following:

a) the number of all bovine animals on the holding and number of all the animals identified and registered in accordance with the provisions of this Regulation,

b) public and animal health considerations, health status of the herds and in particular the existence of previous outbreaks of disease,

c) the amount of annual bovine support or premium claimed and/or paid to the holding, compared with the amount paid in the previous year,

d) results of checks conducted in earlier years, in particular, the proper keeping of the holding register and the proper keeping of passports of the animals present in the holding,

e) whether data on holdings and the bovine animals on these holdings are properly communicated to the rural unit,

f) other criteria to be determined by the Ministry.

Preparation of the report

Article 60- Each inspection shall be subject of a report prepared by the supervisor following the inspection, setting out the results of the controls, any unsatisfactory findings, the reason for the control and the persons present at the inspection. The keeper shall sign the report, as well and a copy of the report shall be given to the keeper.

Article 61- In case any infringement of this Regulation is found out, one copy of the report prepared shall be immediately sent to the rural unit at the provincial level.

Annual reports

Article 62- Relevant rural units shall prepare an annual report at the provincial level and send it to the Central Competent Authority, before 1 April each year. The report shall contain the following information concerning the previous year:

a) the number of holdings with bovine animals in the province concerned,

b) the number of inspections made pursuant to Article 56,

c) the number of animals which have been inspected,

d) any defect identified,

e) any sanction imposed in accordance with this Regulation.

Article 63- Central Competent Authority shall prepare an annual country report before 1 July each year, in line with the reports received from the provinces.

SECTION IX

ADMINISTRATIVE SANCTIONS

Restriction of animal movements

Article 64- Bovine animals shall not be allowed to leave the holding unless they are identified in accordance with this Regulation and they are accompanied by their passport, and certificate of origin and Veterinary Health Report shall not be issued for such animals.

Article 65- If one or more animals on a holding comply with none of the provisions laid down in Article 12 of this Regulation, a restriction shall be imposed on movement of all bovine animals to and from that holding.

Article 66- In case of the detection of animals not identified in compliance with the provisions of this Regulation, if the keeper of that bovine animal cannot prove the identification of the animal and cannot prove that the animal belongs to him within two working days, such animals shall be considered as smuggled and the relevant provisions of the Law No 3285 on Animal Health and Surveillance shall be applied.

Article 67- In the case of animals for which the identification and registration requirements laid down by Article 12 of this Regulation are not fully complied with, until those requirements are fully complied with, a restriction shall be immediately imposed on the movement of those animals only.

Article 68- If, on one holding, the number of animals for which the identification and registration requirements laid down by Article 12 are not fully complied with is in excess of 20 %, a restriction shall be immediately imposed on the movement of all the animals present on the holding. However, in respect of holdings of not more than 10 animals, this measure shall apply only if more than two animals are not fully identified in accordance with the provisions of this Regulation.

Article 69- If the keeper does not pay the charges referred to in Article 37, passports shall not be issued for the bovine animals of that keeper. In cases of persistent failure by a keeper to pay that charge, the movement of animals to and from the holding of that keeper shall be restricted.

Article 70- If the keeper does not notify the relevant rural unit of the movement of bovine animals to and from his/her holding, of the birth and death or emergency slaughtering of the bovine animals on his/her holding as provided for in Article 31, a restriction shall be imposed on movement of all bovine animals to and from that holding by the relevant rural unit.

Restrictions on Slaughterhouses or Meat plants and Animal Markets

Article 71- Slaughtering of bovine animals in the slaughterhouses or meat plants and entrance of the animals to the animal markets shall not be permitted unless they are identified in accordance with this Regulation and they are accompanied by their passport. Work permits of the slaughterhouses, meat plants and animal markets that infringe the provisions of this Regulation shall be suspended for one month. In case the infringements are repeated the work permits of these establishments shall be annulled by the Ministry or by the relevant rural unit at provincial level.

SECTION X

FINAL PROVISIONS

Legislation repealed

Article 72- Regulation on the Identification, Registration and Monitoring of Ruminant Bovine Animals published in the Official Gazette No. 24069 of 4 June 2000 shall be repealed.

Enforcement

Article 73- This Regulation shall enter into force on the date following the third month of its publication.

Execution

Article 74- The Minister of Agriculture and Rural Affairs shall execute the provisions of this Regulation.
